|
|
I'm studying contracts from potential schools, and I came across one that had a provision in case a war broke out.
Does anyone else have this clause? |

I don't have my contract in front of me, but there's a clause that reads something like "This contract may be terminated in the case of war."
Honestly, sounds cool to me!

KPRROK, aren't you way down there in sunny Cheju? Buddy, for you that clause is a mere formality. If the kimchee ever hits the mysterious-fan-death up here, you'll be tanning your hairy hindquarters on the nude beaches of Sogwipo, and don't we all know it. Those of us stupid enough to call the mainland home, we'll just be "terminated", period -- regardless of any contract or clause. |

It's their way of saying if the North attacks, your boss will be flying out of the country with your salary and you're on your own. |

Ha. I laughed out loud. Last time I did that was Season Four of The Simpsons. |

6.4 In the event that war, civil disturbances, or political conditions prompt a directive from the Republic of Korea or the government of employee's citizenship to leave Korea, this employment will be terminated as of the date of such directive.
Goes on to say that days worked up to said date, pro-rata severance pay and fixed amount of XXX, XXX won towards plane ticket will be paid.
Don't you all have this included? |

Oh yeah, everyone should make sure your contracts include all that.
Given that any such "directive" is likely to come VERY FAST and basically amount to "Run for your lives!!!! Oops, there went the airport...", I find it difficult to envision hagwon owners racing to the bank and then back to the office to fulfill their financial obligations to foreign teachers. No, I see something more akin to Saigon, April 1975.
In fact, it would be an absolute miracle if things here went as smoothly as in Saigon, April 1975. |

i saw this clause all the time when researching tax forms for US citizens working abroad. usually you're required to pay US tax on your foreign income if you live abroad for less than one year (along with some other conditions). but if war breaks out, you're exempt.
of course, the clause didn't say "employer" and "employee", just "citizen" or something of that nature...
..darn typos...

Have it stated that your last payment will be made in your home currency.
Not sure how much the won would be worth at that point.
