Thanks again Grotto . You confirmed my feeling about the vagueness and lack of clarity in this contract. (even for a Newbie) The difficulty is that it is apparently a good position so I am going to talk to the school about it and go from there.

Keep looking its a crap contract!
. Job Assignment
Party A shall hire party B as a Teacher in charge of English Conversation Training Program, and Party B shall accept the pertinent position on the terms and conditions stipulated on this agreement.
It sounds like they want someone to make a program for them
2. Term of Agreement
This agreement shall be effective from and shall be expired as of
3. Training Schedule and Course Level
Party B shall execute the training activities in a level suitable to the students' common ability, and shall acquire an acceptance or approval by Party A while Party B shall present the relevant training project and class schedule to Party A in advance.
Basically you have to plan out appropriate lessons and submit them for approval. Negatives: you have to come up with all the material and plan out each and every lesson...thats a lot of prep. Positive if they complain about the lessons you can always point out that they signed off on them.
4. Scheduled Hours for Class
Total class during the regular school term shall be twenty (20) hours per week, and a time span per class shall be five (45) minutes.
I would still like to see a set time: 2-8 or 10-?
5. Salaries and Compensation for Extra Class Work
(1) Party A shall pay One Million and seven Hundred thirty thousand in Korean currency (1,730,000 Won) as the deferred monthly salary to Party B, and outside of that Party A shall lay aside one hundred seventy three thousand (173,000) won for the retiring allowance (bonus), which will be paid at the expiration of this contract.
Salary sucks and they are making you pay for your own retirement fund(as I interpret it) For the job they are asking you to do it is much too little doiugh for way too much work.
(2) Party A shall pay the twenty thousand Won in Korean currency per extra class work in case of exceeding to the twenty (20) class hours per week assigned.
(3) In case Party B makes an absence from the class without any appropriate or justifiable reason, Party A shall deduct the Twenty Thousand in Korean currency (20,000 Won) per class from Party B's salary.
Again who gets to decide whether it is justifiable? The boss! I dont like this clause.
6. Work Schedule
(1) Party B shall duly fulfill his or her duty on the schedule assigned in accordance with the academic calendar and the operation code of the school authority from 9:00 a.m. to 6:00 p.m..
(2) The dates on duty are Monday through Friday (Five days per week.)
(3) In case Party B shall repeat to make an absence from the class without any appropriate or justifiable reason, Party A shall have the right to terminate or null the agreement.
Say what?? They want you there 9 hours a day???? What is this 20 hours crap?? Basic math makes that 45 hours a week. Thats too much time for a crappy 1.7 IMO
7. Assignment During Academic Vacation
(1) Party A shall pay the salary to Party B during the vacation without the regular class schedule.
(2) Party B shall provide the two weeks' training class during each vacation, summer and winter vacation. The rest of the vacation can be used privately. How long are the vacation periods? This should be stated as the exact amount of days you will get off. Too vague for a contract!
8. Accommodation & Air Fare, etc,
(1) Party A shall provide Party B with the Two Hundred Fifty Thousand in Korean currency (250,000 Won) as the cost of living every month and the lunch during the days on duty.
(2) The utilities including the heated room, telephone, etc. shall be paid at Party B's own expense.
(3) Party A shall provide Party B's airfare for the one way from ( ) to Korea in principle after one month from the date to be started the contract with our school.
So what exactly are the accomodations? 250,000 doesnt get you much!
In case Party B shall duly perform the terms and conditions on this agreement, Party A shall pay for the airfare for party B's returning to home.
In case the termination of an agreement of Party B's own free will or the termination of an agreement of Party B's own fault, Party A can redeem given air fare.
Again ? SAY WHAT ? poorly worded.
9. Activities Beyond Regular Work Schedule
Party B shall not take part in or perform the activities specified as follows outside the school without a prior consent or approval from Party A. Description : a) Private Tutoring for a profitable or non-profitable purpose. b) Business Activities including an extra job for a private earning.
10. Attitude In Teacher-ship
Party B shall not execute the punitive discipline like a beating on the students, and shall keep a moral attitude on Teacher-ship not to be blamed from the student parents.
Again SAY WHAT? Speak English!
11. Surety-ship for Performance
Party B shall provide a surety bond in the documentary form to Party A as an affirmative evidence to fully accord with the terms and conditions on this agreement, and the related surety bond shall be issued by one of the reliable underwriters in Korea territory.
Again say what? What the hell is this crap? No freaking way! Run! Run and dont look back!
12. Qualification
(1) a university graduate with a Bachelor's degree
(2) a professional(special) school a major of English
13. Party B shall submit the certified documents assured for qualification as English teacher or lecturer to Party A as follows.
* Certificate of Graduation with the bachelor degree and transcript from the four or two years college, university.
* All other documents required including the entry visa application to Korea.
* A personal history.
* Certificate of Alien Registration
Kind of hard to submit that certificate of alien registration before you get there
14. Days off or Red Letter days
Party B shall take the following days off on duty;
* Saturday, legal holiday, the day of the ceremony of opening school, etc.
15. Termination of Contract
(Termination by Instructor)
The School recognizes that special circumstances may develop which requires this contract to be amended or terminated prematurely (serious illness or death of immediate family or self, etc.) The School will endeavor to accommodate the Instructor's specific needs in such situations, evaluating these needs on a case by case basis. If the Instructor's resignation is determined to be voluntary (unilateral and without just cause), the school can call in the air fare paid in accordance with the Clause 3, Art 8.
No way Jose! After 6 months this is one Damacles sword that should no longer be held over your head!
If the Instructor's resignation is determined to be voluntary (unilateral and without just cause), the Instructor may be assessed up to 1.5 million won for the costs in recruiting and placing under contract Instructor's replacement, If, however, the Instructor has worked more than 6 months under the contract and gives the School at least one month notice of Instructor's intention for all of the above costs, excluding Instructor's replacement cost
Again no way. For someone to put a clause like this in makes me wonder how stupid they thing we are
By signing this contract, Instructor certifies that he or she has every intention of fulfilling his or her obligation for the duration of the contract and that there is no reason that he or she should not be able to enter into such a contract.
(Termination by School)
This contract cannot be broken by the School without just cause, which includes, but is not limited to the following situations;
1) when the Instructor is found to be in breach of the contract or is involved in a scandal that may tarnish the reputation of the School
2) Instructor's possession or use of illegal and/or illicit substances
3) excessive (unexcused) absenteeism and/or tardiness
4) when the School concludes that the Instructor cannot perform class activities
4) we decided you cant speak English anymore, goodbye
5) when the School concludes that the Instructor has a poor attitude, or lacks the qualities necessary to be an effective instructor.
What about the schools poor attitude which is manifest throughout this crap contract!
6) when submitted papers are found untrue
7) when the Instructor becomes an offender against the law
when the Instructor takes part in or performs the activities specified as follows outside the school without a prior consent or approval from Party A. (Private Tutoring for a profitable or non-profitable purpose.) or contravene the Art 9.
Miscellaneous Provisions - in the events that Party A acknowledges.
The Instructor's employment cannot be terminated by the School without the Instructor being duly warned about his or her poor performance and/or attitude, and given the opportunity to remedy the problem, unless Whe the instructer becomes and offender against the law I really think they should give you the benefit of a doubt and say 'if' the Instructor's performance and/or behavior are deemed particularly egregious such that immediate termination is necessary in order to save the School��s reputation and education standing. If it is deemed that Instructor intentionally (via blatant disregard for the rules or well-being of the School) forces the School to terminate Instructor's employment, then the School may assume that the Instructor has voluntarily terminated the contract.
16. Miscellaneous
(1) In case there shall be any of the inevitable situations to modify or change, revoke the terms & conditions on the agreement, the both parties shall treat the pertinent matter through an amicable and mutual negotiation. The other matters not specified in this agreement shall be settled depending on the common practice acceptable in a social concept.
2) This Agreement shall be made of the Languages in Korean and English in duplicate, and its priority of interpretation shall be placed on Korean.
Never agree to any interpretation of a contract in Korean. Unless you read Korean fluently they can change whatever crap they want.
By signing this contract, 'Party B' acknowledges and agrees to the purpose of the contract, and 'Party A' agrees to provide the necessary information regarding the conditions and termination of this contract.
Party B is also agreeing to the fact that Party B cannot sign another contract with any other organization or for personal profit-making without Party A's permission.
LMFAO! The last sentence is ludicris beyond belief! Sorry dumbass I can sign another contract pretty much anywhere I damn well please!
This is a crappy contract written very poorly with way to many contradictions, vaguaries and blatant one sidedness to be plausible. Keep looking.
Just out of curiosity is this position at a Church run school? It looks like one of their clusterfxxks! |
