Ok so my contract says
A The period of employment is for May 16th 2005 to May 16th 2006.
B The teacher agrees to discontinue his/her residence in Korea under the visa status arranged and sponsored by employer and leave from the status within five days of termination of the contract.
However I didin't get my visa straight away so technically my visa runs out on the 21 Jun 2006 (I was admitted on 22nd June 2005).
Is it likely that my employer will make me work to the end of my visa or the end of my contract? What I really mean by that is- is the law on my side if I enforce the contract finis date considering it shows that I worked ilegally for a period of time at the begining of my contract?
I want to make sure that I get my severance pay and I also may want to find another job in Korea so I dont want to have problems at the end of this one.
Cheers for reading this - I know it is not exactly exciting! |

Take a look at the date on your ARC. Does it match either the contract date or the date on your E-2 stamp? It should match your E-2 visa. That date determines when your legal residence ends. Ask your boss when he expects you to stop working. |

I had the same situation last year, except that my visa was 3 months out of sync with my contract.
I couldn't get a clear answer as to what I should do, so I left at the end of my contract.
It was really strange because about a month before my contract finished, the boss wanted me to go to immigration and extend my visa. I showed him my visa and it was good for another 3 months.
It could be that your boss will want you to stay an extra month, but even if that is the case, would it be so bad? As long as he is paying you..I mean.
I hope things work out. |

thanks guys,
I should have been clearer on why I want to figure it out just now. I really wouldnt mind working a month longer at this school but my mum and aunt are coming over and need to book there own holidays from work. I want to take them around a little and then maybe go somewhere else in asia with them so I want to have finished work byt the time they come. I also dont want to *beep* my boss over at the end either so want to kind of figure it out just now!
I may ask my boss but unfortunately he gets so stressed at everything that mentioning that I wont be here forever is likely to send him into a complete spin that I wont get a straight answer!
thanks again |
