I just looked over my contract, I hadn't looked at it in a while because I have a decent school and I haven't had any problems....or so it will seem
My work hours are 2.00 - 9-00 Mon - Fri, which I have worked for six months, now looking at my contract it says 2-00 - 8-00 Mon to Fri, maximum of 30 working hours NOT classes a week.
I am doing 35 Hours a week.
Here's my problem, I like my school and I have had no real worries, if I fight this and demand the overtime, which is around 2.6 million backpay and a change in hours, it will no doubt bring bad blood between us.
Advice please... |

This is what i would do if i liked the school...
*I would bring in the contract and point out to them that the hours you worked should have included overtime..
*Then, i would point out that because I liked the school and have enjoyed working there as a show of goodwill I don't want any extra money from the start of the contract until now..
*However from this month onwards any time i do which is considered overtime according to the contract i would like to be paid for....
Sounds like they have been screwing you a little and probably knowingly so if after this they point blank refuse I just wouldn't work anymore than 30 hours and any later than 8 o'clock until they agree... |

The previous post from just because is one way to go about it. However, let's be honest here... part of it is your own fault for not paying attention to your contract. You have to take some responsibility for that. Your employer might not know or remember the hours on the contract either. So before you even think about a confrontation over the matter make sure to ask your boss if he/she remembers what the contract said about your hours. As for getting the backpay, they probably won't want to pay you. If they won't, I wouldn't do anything about the backpay until the very tail end of the contract or afterwards where you have another job lined up and then you can go to the labor board. Also, you can always refuse to work that extra hour each day and take the risk of having "bad blood." Just remember it is partly your fault here for not paying attention very closely to the contract in the first place. |

What you have said here is exactly what i have said but in a different way...
I would just show them the contract and wouldn't ask for any backpayment at all as it is partly my fault that I missed the finer details but if they wouldn't pay me from this time onwards after the fact that all parties were aware then i would start amking a bit of an issue of it and refuse to work the overtime hours...you are not breaking any rules.. |
