She has a right to complain. What Gyeonggido is doing is ILLEGAL. And just bending over and taking it sets a very bad precedent for the future. |

Exactly.

It isn't a big deal on the surface, but as I said before, it is not written in my EPIK contract (it is in the Wisconsin and GEPIK ones) and I have not received any record of it being taken, nor have I signed a written agreement.
It is about the PRINCIPLE, not the money (even though I could have that money earning some decent interest at home while they hold it).
Why should it have been in the contract? The EPIK contract is for NETs nationwide. I signed my new contract at the beginning of August and it was almost 3 months later that he decided to 'spring' this on us.

As I said before, I think it is because NO ONE ELSE HAS BEEN INFORMED. Or else the latest intake of EPIKs in Gyeonggi have been informed and they are not aware it is WRONG.
Sure it makes me look bad, but I refuse to let him walk all over me without a fight. |

It would seem like something reasonable because the school doesn't want to be responsible for people skipping out on their bills (which teachers should pay anyway). Also some teacher before they run have also destroyed the apartment they are living. This is not fair to the school either. They deserve some protection from this kind of action...it seems fair to me.

I don't know how anyway can believe that the deposit will give the schools any kind of protection against runners. Think about it... they leave and lose their return airfare and month bonus already. The deposit will make no difference. Maybe now runners will sell some of the school's things before they go or take a computer with them or leave even bigger bills. The provincial board of education should know how to follow the law. The man in charge is a liar and I wish he'd be fired (it's a lie that there haven't been any other complaints to the Gyeonggi Board about the deposits). Maybe they should say that salaries will be lower for the first three months, but an additional bonus of that amount will be provided at the end then depending on unknown conditions. It would be legal, but they'd probably have a smaller applicant pool. What might reduce their risk is if instead of charging an illegal deposit, they would open/create lines of communication to resolve problems fairly so things don't escalate until someone runs.
Another thing, not every school, every year is going to return the deposit in full. No way, especially not when they don't say exactly what it covers or even plan to pay it back until you've left Korea. Not all schools are competent or trustworthy when it comes to money either. My school expected me to sign a false budget to get more money from GEPIK. I wouldn't so they submitted it without my signature. And, I've been paid late twice. |

Such audacity! WHO DO YOU THINK YOU ARE?!!? You will be paid when we see fit. Student loans? We don't care. Rent and bills? As you know, all foreigners don't pay their bills on time and always run like cowards, so we don't care. Why do you always have bills that others haven't paid when you move into an apartment? THAT IS THE KOREAN WAY!!! You do not understand KOREA!!! Stupid foreigner! A mortgage? We don't care. A child? We don't care. We pay you later than the Koreans because WE DON'T TRUST YOU! Don't you know that? SOOOO many foreigners are dirty and have taken blow torches to our WONDERFUL apartments. SUCK IT UP! Oh, so sorry. We forgot. Ha ha! Maybe tomorrow...
Seriously though, it should be in the contract. If they try to withhold it, I'd fight it, too. For some people, a hundred bucks does make a difference. Best of luck. |

Thanks for your good luck. |

Sorry, I was looking at things on a month-to-month basis as that's typically a bit of a scheme they try to use. It's only a bit of money; they won't miss it. As you know, foreigners are stupid and can't see the big picture. If you get it back, minus unpaid utilities, that's fine. However, they should just let you ride the year out without it as they were the foolish ones to have a problem with understanding possible future consequences. Plus, it you are showing that it bothers you, they should understand that. Didn't you finish one contract without problems? Keep all pay stubs and make photocopies and don't let it affect your teaching...THEY also seem to have a problem understanding that. While we're on the subject, isn't that a bit of what severance is all about? Don't they take any unpaid stuff or damages out of that? |

Contact the labour board. Tell them the situation.
Labour laws overrule illegal contract clauses.
Forced savings are illegal.
Deductions for deposits from your cheque are illegal and the labour board will put a stop to it. It is as simple as a phone call. call 1350 and ask them to tell the morons at your school that it is illegal. They will and that will be the end of that! |

Grotto,
if you read the end of page 2 of this thread, you will see calling the Labour Board has not seen the end of that... and I'm fighting the Big Guy at Gyeonggi Office of Ed, not my school. |

Stick with the labour board. Call in and make a formal complaint. You may have to fax in a copy of your paystub(make sure you are getting one).
Also dont be afraid to get in their face a bit. Tell them that you know of other teachers who do not have this deducted! That it is illegal and they have already been told by the labour board to cease and desist.
The labour board will put an end to it eventually. |

I think this is way too confrontational in such a simple situation. I am not sure if you give responses like this to your employers, but if I was your employer I would show you the door. You are definitely a distruptive force. I have been reading the advice you give, I am just wondering of your qualifications if any. |

What do you suggest should be done then? It seems like Etuboko has already tried to reason with them, but has already had the second deposit payment withheld. Doesn't seem like they're listening at all to him/her. Etuboko's not happy with the situation of her workplace trying to entrench some kind of illegal clause into her contract after she already signed a contract...one that is on file with immi. A contract and its clauses are to be agreed to by both parties. These places definitely shouldn't be allowed to change whatever they want, whenever they want. Respect is a two-way street, right? |

| I agree, in part, the part that I dont agree with is "get in their face a little." He should go to the labour board and such, but "getting in their face" isnt going to do a hill of beans, except piss them off. You can get your own way, there is a right way and a wrong way. What Grotto is suggesting, I believe, is the wrong way. |

Just another reason not to use provided housing.
I stopped using it, and I will never use provided housing again. Getting your own place is not nearly as hard as you may think, and it is worth every penny. |

| I signed a contract that has a 300,000 won deposit for three months. Really I don't see the problem here. Simply make sure the apartment is clean and decent and you should get it all back. |
