Can you sign and then back out before the E-2?

You can also be blacklisted if the school opts to file a claim with Immigration after a teacher runs rather than them just simply notifying them of the terminated visa, but your situation sounds more like you'll be doing an ethical breach of contract, rather than Korean immigration laws.

Knowing that schools and their staff are notorious for browsing these forums, it's a good thing that you're not stupid enough to use a picture of yourself posing with friends in your avatar, while candidly posting about your plans to screw your school. Rolling Eyes

Interesting take.....technically the contract doesnt become active until the new visa is activated...as she would be backing out before the visa became active then vis a vis there is no breach of contract as it was not in force at the time of the leaving.

I believe if you had the E-2 visa put in your passport in Japan, BUT did not return to Korea to finalize it, then it (the E-2) is only good for 3 months/90 days. Unless the school filed some sort of claim (unlikely) then after those 3 months you should be good to go.

However depending on your exact circumstances (and how Immigration is feeling on that particular day Laughing ) they MAY give you some trouble about not processing that E-2.

My point is that the contract becomes legally binding upon signing...like in western countries. If the school trusts what she is saying and then loses financially due to her fraud. Yes, I said fraud. She is technically commiting fraud if signs the contract and they trust in that and lose because of it. She is knowingly signing a contract she has no intention of fullfilling. So...look in a dictionary and see why I say fraud.

** She should grow or borrow a backbone and discuss things like an adult. Teachers are as bad as the school bosses. The school wants to know early if she will re-sign...why is that bad? She can say"I don't know yet, I will tell you by the deadline". Grow up and discuss things like a normal person...not like a child.

** Maybe you should go home before you cause the rest of us more problems. Things will never get better if actually encourage teachers to act like this, be honest and say that is not okay.

This is also what I said earlier. A board that complains so loudly about teachers being screwed and periodically calling for major change, such as forming unions and whatnot, should NOT be fostering advice on how to make the trust divide even wider and make things worse for the next people coming in.

Sadly, in the end, teachers will always do what is best for themselves, regardless if their actions may impact those around them, or if the teacher being brought in to replace them has to face a director that now has a much larger chip on his shoulder when dealing with foreign staff.

That road runs both ways. If she felt that she was dealing with ethical adults who would handle the situation in a mature logical fashion she most likely would not have posted.

As she is dealing with a hogwan owner.................Hmmmmmmm.

What goes through your mind? Hey I should sign now? Geez these guys are idiots! Wow they must love me!
What goes through my mind is: wtf? Why are they being so aggressive so early on? Why arent they asking what it would take to keep me another year?

Perhaps if the director didnt have the chip on his/her shoulder to begin with there wouldnt be a problem.

It is up to the teacher to do what they think is in their best interests as the track record of hogwan owners/directors is abyssmal!

Chronic and Bellum you seem to be willing to put forth alot of trust into the hands of (from the OP) a seemingly disreputable Korean. Oh of course you guys arent the ones screwed out of pay/severence/airfare etc if things go wrong.

Seeing that none of us are actually there, all we are doing are speculating and judging. Until I work 6 months at the same school as the OP I would never dream of calling her immoral or dishonest.

I would be totally pissed, if they pulled that at 6 months. But no one said anything about 6 months. We're only talking 2, which fits in a timeframe that's not unheard of.

Actually, she works for a public school. Your advice would be better heeded if you got yourself up-to-speed here. You're the one that is letting your industry bias sway the direction of your advice, without first understanding what any of us are talking about.

I don't know how you overlooked that, but given your history of advice, you should be advising her to NOT sign that contract, yet you are actually encouraging her to sign it as a 'safety', in case something better doesn't come along. You might want to take a moment to first gather thoughts and figure out what your intended message of advice will be, as to not risk contradicting yourself with your past posting history.

What it irrefutably boils down to, is that she should not sign a contract that she does not have plans to uphold, under any circumstance. It doesn't sound like a very good contract to begin with, and if she looks anything like the girls in her avatar, then recruiters and other schools will be falling all over themselves to sign her to stellar deals of her choosing. And she's got 2 friggin months to line up something better! Gimme a fucking break! Rolling Eyes

Keep looking for another (better) job until Dec. 30. If you find one you have no dilemma; if not, re-sign (on the 31st) and keep looking. When you find one, resign (giving notice) and take the new job. Your letter of release may not be forthcoming unless you are not prepared to play 'hardball' i.e. call (it helps to have a native, K-speaking friend) the parents of all the kids to 'explain' a few things.

I don't understand why this is a problem. You don't like this public school, you've made that clear from previous posts. So don't resign!! If you have been so damn unhappy, it's not worth it with them. Also, by saying you won't sign again, they may try to work with you a little more on the contract.
No matter what you do, try to act maturely. Say to them that you won't sign anything until you're ready. Stick to this point and play a waiting game. It sounds like you feel pressured by them. I don't really understand why.
