The Employer will allow the teachers 3 sick days paid a year. In case of exceeding 3 days of illness, the Employer may deduct a day뭩 pay for every day the Employee is absent from work or deduct days from holidays. The Employee must notify the Employer at least five hours before class time of illness with the doctor뭩 diagnosis.
9) The Employee shall not be absent without the Employer뭩 permission 2 days in advance notice.
Taxes
Taxes and deductions in compliance with Korean Law shall be withheld automatically from the Employee뭩 monthly salary. The deductions will be income tax, residence tax, medical insurance (50%) and so forth if any, from monthly and severance payment. Income tax rates will not exceed 4% of the monthly salary.

I agree with most of the criticisms of the contract that have been given so far. There are two other things that stick out in my mind. One is the contradiction about how much advance notice you have to give of when you will be sick. Is it 5 hours or 2 days? Well, either way it's a BS clause. If you really want to work for these people, I'd insist that the language be changed to something like this:
"If Employee is going to be late or absent due to unforeseen circumstances such as illness, Employee will give as much advance notice as possible to Employer."
Also, pension is conspicuously absent from the taxes that are to be deducted. All employees in Korea must contribute 4.5% of their income (in your case about W90,000/mo) to the National Pension Fund, and the employer must match this contribution. Since it's not mentioned, it looks like your boss is trying to be stingy and weasel out of this.
If you are American or Canadian, you want to contribute to the pension scheme because you can collect all of this when you leave Korea for good, which amounts to an extra W1,000,000/yr. If you are not from America or Canada, you probably don't really want to contribute to this because you won't get any of it back. FYI, either way, not contributing is breaking the law. |
