So let me get this straight, if someone's contract ends at the end of March but their ARC expires at the end of April, then legally they are allowed to stay in Korea until the end of April even if they aren't working anymore? Isn't that what you are basically saying ttompatz? If so, then it's as clear as day if not, then I'm somewhat confused |

As far as I know, if immigration law hasn't changed, a foreign national

they have 14 days to depart. |
Again... speaking with both feet in your mouth and not current information.
You do NOT have to leave Korea within 5 days of the end of your contract. This is misleading.
Quoted from above for those who haven't read it yet.

What you have to do is:
A) leave Korea by the date indicated on your ARC. You may re-enter anytime as a tourist or other visa.
or
b) Before the date indicated on your ARC, go to immigration and apply for a "change of sojourn" to change your status from E-2 Status (Teaching Foreign Languages) to C-3 Status (Short-term Visitors) and your reason is tourism.
COST IS 50,000 won... COST IS 50,000 won... COST IS 50,000 won...

(1) The Object of Permission
When a foreigner desires to cease his/her present activity and concentrate on an altogether new activity which falls outside those permitted by his/her status of sojourn, he/she should apply for and obtain this permission(article 24-1).

| Well, my ARC expires February 25th but my contract ends on the 28th. I am leaving on March 3rd. My boss says you have 14 days after the date on your ARC. |

... and you bear the risk of having to pay a fine of up to 100,000 won for an overstay.
30 minutes at your local immi office will eliminate this problem.
Your boss is either mis-informed or plain lying to you. |

It all depends on your nationality. Typically 30-180 days. |

| What is this clause that so many hagwon contracts in Korea seem to have? Is it a legal requirement for teachers to leave within five days of their contract ending or just something that the hagwons have invented to make it more difficult for teachers to deal with any problems they may have? Can anyone confirm or deny the legality of this clause? |

No leeway after the end of the ARC? not that 5 day thing someone mentioned? If so I have to teach until 5pm and then leave the country on the same day unless I get that extension. Sucky. |
Me, too. My situation is similar. The date on my ARC card is February 25th but my contract finishes on the 28th. I have to teach until the 28th..I have no choice plus March 1st is a stinking holiday and I have to make sure I can wait on my school to pay me and close out my bank account so I am leaving on March 3rd. Another girl at my school has the same deal. |

So drag your boss down to the immigration office and fix it for you and your co-worker before you get stuck in an overstay situation and risk the fine and delays when you try to leave. You still have 3 weeks to fix it. Go with your boss to make sure it gets done and not just his "say-so". It's YOUR ass on the line... not his and you need an extension not a change of sojourn. Cost is only 30k won.
IT would SUCK to miss your flight while they piss around cause you have to pay the fine for your overstay and they have to wait for lunch to finish first. |
