This Employment agreement has been made on this day From
To between Kids club in Boon-dang with its principal office at Good morning plaza B/D 3rd floor Gumi-dong Boon dang-Gu Seong nam-si Kyung gi-do Korea(here in after referred to as the ��Employer�� and_______ a citizen of __ __(here in after referred to as the ��Teacher��). The teacher is hired by the Employer and both parties agree on the following terms and conditions.
1. PERIOD OF EMPLOYMENT
a. The total agreement term is for one year, commencing and finishing on _ _.
b. The term of this agreement includes all scheduled vacations and holidays that fall between or during the teaching sessions.
c. The teacher agrees to discontinue residence in Korea under the visa status sponsored by the employer within five days of completion of this employment.
d. The employer and the employee agree to provide the other party with 30days advance notice of termination of this contract in writing. In live of 30 days notice, 1 month��s pay will be provided. As per article 32 of the labor standard act.
2. CONDITIONS OF EMPLOYMENT
The teachers work shall consist primarily of the following:
a. EFL instruction in any and all phases of the institute��s program to classes
That range from pre-school to adults.
b. Curriculum design and implementation.
c. Development of educational programs and materials.
d. Out of classroom activities for/with students.
e. Grading and evaluation of students.
f. Student counseling and evaluation.
g. Attendance at meetings and workshops.
h. Other school related activities.
3. Duties of the teacher
a. During the term of this agreement, the teacher shall cooperate, and comply with the instructions, the training and supervision of the Academic Supervisor, and shall carry out such assignments as directed by the Academic Supervisor. These duties shall include the instructional program, related to the teachers classroom duties, attendance at scheduled staff meetings/workshops, and any additional duties as assigned by the Academic Supervisor. The Academic Supervisor is responsible for establishing and commuinicating the Standards of Performance as related to the above mentioned duties.
b. If the teacher does not show up for class (even with sudden notice), the employer will judge the situation and the teacher shall follow the decision. The situation might be considered as a sick day, or a nonsick day.
4. SALARY AND OVERTIME
A monthly salary of 2,000,000 won will be guaranteed for this time schedule per week like 10:00am ~ 5:50pm on M,W,F AND 10:00am~4:20pm on T,TH. (about around teaching hours) One class is Kindergarten (10: 00am ~ 2:50pm for everyday) 2classes more on M,W,F after Kindergarten. That class is 80 minutes. This salary will be paid on the tenth (10th) day of the following month. There is a ten days holding in the pay period. The pay period works as follows. For example, if the teacher works December 01 to December 31, the teacher will be paid for these days on January 10th. The overtime pay will be 18,000 won per working hour. Attendance at scheduled staff meetings and workshops are unpaid, and will not be considered as overtime.
5. WORKING HOURS
Classes are held from Monday to Friday. During the term of this agreement, the teacher shall be required to work well and closely with the Academic Supervisor, at the times the Academic Supervisor shall direct. No regular schedule of work hours as requested by the teacher can be guranteed to the teacher. The teacher will never be required to work ��split shifts��. (It means over two hours between the classes.) The teacher will never teach before 10.00, and never after 22.00.
6. TAX
Income tax and retirement taxes will be observed from the salary according to the Korean tax law.
7. Transportation
Round trip economy class airline tickets will be provided to the employee, if the teacher willfully leaves the school before 6 months, the amount for airline tickets to & from Korea will be deducted from the funds due to the teacher.
8. Medical Insurance
The teacher will be covered by medical benefits under the Korean Medical Insurance Union, a private health organization. The cost of this coverage will be paid half by the teacher, and half by the employer. Payment will be deducted from the teachers salary.
9. Vacation and Holidays
a. Holidays: There are 13-15 Korean holidays per year. The teacher is not required to work these days.
b. Annual leave: The teacher is permitted ten (10) days of paid leave per year. The teacher agrees to give at least ten days notice in advance. Paid leave cannot be taken more than 5 days at a time. The vacation can be taken at the teacher��s convenience. But you must take your vacation at the same time as school��s vacation.
c. Unpaid leave: Unpaid leave is permitted only under extreme circumstances. Extreme circumstances are considered, but not limited to, death or serious illness of self or of an immediate family member. Upon presentation of proper notice and proof to the Employer, the teacher may be guaranted up to five (5) days of unpaid leave.
d. Sick leave: The teacher is allocated up to three (3) days of paid six leave per year. Any unused sick leave will be paid to the teacher, when the contract is completed. In order to be eligble for paid sick leave, the teacher must notify the employer, with an accommpanying proof of illness from a physician, at least one hour prior to the commencement of class. If the teacher fails to notify the employer with proper proof of illness, the employer has the right to deduct a days pay for each day that is missed.
e. Tardiness: If the teacher is more than 10 minutes late without notification, one hour of pay may be deducted
10. Housing
The employee may choose one, of the two options :
a) The school shall provide furnished living accommodations. Furnishings provided by the employer include selection of a private apartment, will be made by the employer, with the agreement of the teacher.
b) The employer will provide one room fee, in housing allowance to the employee.
c) The apartment will have the basic neccisaties such as kitchen equipment, a bed, a television, and a washing machine. In either case ��a�� or ��b��, the employer will provide.
11. Severance Payment
Upon completion of this contract, the teacher will receive one month salary (2,000,000 won) as severance pay in accordance with Korean labor laws. This payment, with all other due monies, will be paid at the completion of the contract period, which is the last day of the contract.
12. visa
The teacher will receive an F2 visa paid by the school. |

I have a friend who is already working there and he is really enjoying it. No complaints. My main concerns are:

What does "in live of 30 days notice" mean?

They say "immediate family member." I wonder if they'd let me leave if, for instance, my grandmother passed away.

Its always nice to know ahead of time what the evaluations consist of and how often the meetings and workshops are.

Overtime is a bit low

Not a good sign! With this clause they could make you teach 12 hour shifts. In a contract work hours need to be stated clearly.

Penalty clauses are illegal. If you are runnning late just skip that class...you're not getting paid for it anyway!

I would ask to have an exact percentage added for the taxes...it should be 1.6 per cent for 2 million won.
The wording on the medical insurance is weird. It is mandatory for you to be enrolled in the national medical plan. This is a government corporation, which means that it is not private, but public. If they're trying to give you private insurance, that's not a good sign. The deduction should be a little over 2 per cent of your monthly pay. I would clear that up.
There is no mention of pension. It's a 4.5 per cent deduction that is matched by your employer. If you are from Canada or the United States you get it all back when you leave Korea. It is mandatory for you to be enrolled in this plan and if they aren't offering it you, you're losing a nice bonus.
Under the housing section, what the heck is a "one room fee?" I would get that clarified. |
