HELLO! This is the contract that was sent to me... the vacation days are: 10 and the salary is 2.1mill won/month. Can anybody give me any feedback? i think it sounds good but perhaps im missing something that u guys can see. Thanks!!

Letter of Agreement
The Gangseo SLP Institute (hereafter �The Institute�) under the license of SLP,(Corp) Sogang University and (hereafter �the Teacher�) agree to a contract for regular full-time English teaching as follows:
TEACHER OBLIGATIONS
A. Supervision
The teacher will work closely with academic supervisor and other colleagues in the planning, observation, and review of instruction.
As a member of the Institute, the teacher will contribute to the cumulative experience, wisdom, and resources of a team dedicated to developing, implementing, and evaluating a comprehensive program for teaching English to Koreans.
B. Behavior
The teacher should respect the rules and standards of conduct of the Institute (written, verbal and tacit) and obey the laws, regulations, instructions, and ordinances of the national and local governments.
Any teaching or employment other than at the above address shall not be permitted, in accordance with Korean Law. Non-compliance may result in discipline including fines and deportation.
C. Workload
The teacher will have at least 21 80-minute classes per teaching week.
If the teacher works less than 21 80-minute classes per teaching week, the teacher will be asked to do duties like research and development work under his or her supervisor�s direction. The teacher may work longer hours during the summer and Winter Vacation.
Due to the way Korean education system works, this schedule is unavoidable.
Overtime will be given over the hours of agreement.
The Teacher is expected to devote no less than 1 hour a day at the Institute for lesson planning, student evaluations, teachers� meeting, consultation with parents, and supervision of play. Upgrading one�s professional knowledge and skills is without additional pay. The workweek will follow the yearly academic calendar issued by SLP, (Corp) Sogang Univ. The total teaching load including overtime will not exceed for any given week 25/ 80-min classes a week, unless both parties (employer & employee) agree.
Staff meetings will be scheduled at the discretion of the Institute Director. Attendance is required. Staff meetings will allow time for discussion of topics of current concern within the program such as new policies, procedures, method of training, instruction, curriculum, and other matters as needed. Staffs are encouraged to help work out practical solutions to problems at these meetings.
The preparation and attendance for special events such as Field Day, Halloween Party, Speech contest, etc. demands the teacher to stay in school for a few days Saturdays in a year and the party itself lasts during the regular school hours.
D. Special Research Projects
Any part of the teacher workload converted to research and development work by the institute will be remunerated according to Section E.
E. Overtime
Over time teaching is paid beyond 21/80-min classes. Overtime will not be paid on holidays, sick days, or emergency leave days. The assignment of overtime above the regular 21classes and less than 25 classes is at the sole discretion of the Institute. The over time rate is 30,000 won per one 80 min class.
F. Work Schedule
The workweek runs from Monday through Friday in monthly periods. The Institute Director will assign the teacher�s schedule. If the teacher has morning classes, teachers will be expected in the institute at least at least 30 minutes prior to their first class. If the teacher have late classes, teachers will be expected in the institute at least 60minutes prior to their first class, Monday through Friday, according to Section C.
The institute director and supervisor reserve the right to decide the teacher�s work schedule as follows:
a Classes begin and finish on Mondays Wednesdays Fridays at 10~7:20.
Classes begin and finish on Tuesdays Thursdays at 10~4:20.
b Classes begin and finish on Mondays Wednesdays Fridays at 10~5:10
Classes begin and finish on Tuesdays Thursdays at 10~7:20
c.Classes begin and finish on Mondays ~ Fridays at 1:30~8:50.
d Classes begin and finish on Monday Wednesday Friday 10~3:40
Classes begin and finish on Tuesdays Thursdays at 10~8:50
TEACHER BENEFITS
A. Monthly Salary
The Institute will pay the teacher a total monthly basic salary of each month. The monthly salary is based on a calendar month, not the monthly teaching session. Korean income tax, National Pension & Medical Insurance will be withheld from the monthly salary.
B. Housing
The Institute will provide each teacher an apartment / house. The apartment will contain TV, refrigerator, washing machine (or you can use a laundry) , wardrobe, telephone, gas range, bed & Korean style bedding, , and some eating & cooking utensils.
C. Health Insurance
The teacher will be covered by Korean National Health Insurance. According to the government guideline for teachers, the monthly insurance charge will be shared by the Institute and the teacher. Coverage will be from the date of joining to Korean Medical Institute Union, commencing approximately 3 to 4 weeks after the teacher�s arrival of Korean due to requirements of the immigration and taxation department. However, it is not mandatory for foreign teachers.
D. National Pension Plan
In accordance with Korean Law, all foreign workers employed by Korean businesses shall pay into the Korean National Pension Plan at a rate of 9% (or the ratio stipulated by the Korean National Pension Law) deducted against monthly earnings with the employer�s contribution of 4.5%
Refund of the National Pension to a teacher who becomes a compulsorily insured employee, where the Pension Act of the teacher's home country provides the benefit corresponding to the lump-sum refund of the National Pension Plan, the lump-sum refund of this plan shall be paid to the foreigner according to Korean Law.
E. Paid Sick Leave and Emergency Leave
Documented sick leave and emergency leave will be paid for a combined total of five workdays a year. The teacher should provide the institute with as much advance notice as possible. Unused sick leave may not be converted into any cash payment. If it is found that the hours/days of absence reported as sick leave or emergency leave were not in fact for such purposes, related costs shall be subtracted from the following month's pay. The above leaves will be included in the period of medical care compensation according to the Article 78 of Korean Labor Standard Law.
At the end of he contract period, if a teacher has not taken any days off or missed any days of work he/she will be compensated a total of 500,000 won for his/her faithfulness to his/her job.
If a teacher misses no more than 3, 80-minute classes he/she will be compensated at the rate of 500,000 won.
If he misses 1 � 3 , 80-minute classes he will be compensated at the rate of 400,000 won.
If he misses 4 � 7, 80-minute classes he will be compensated at the rate of 300,000 won.
If he misses 8 � 11, 80-minute classes the compensation is 200,000 won.
If he misses 12 � 19,80-minute classes the compensation is 50,000 won.
But if he misses as many as 20 classes there will be no compensation.
If a teacher exceeds the allocated five days sick leave, the teacher will have 1.5 times the hourly wage deducted from his or her salary for every class missed.
In case the teacher fails to complete the contract the teacher should pay back to the
Institute the total amount of sickdays that were used as follows:
If you missed 1~3classes, a teacher will pay 100,000won.
If you missed 4~7classes, a teacher will pay 200,000won.
If you missed 8~11classes, a teacher will pay 300,000won.
If you missed 12~15 classes, a teacher will pay 400,000won.
If you missed 16~20 classes, a teacher will pay 500,000won.
F. Air ticket
The Institute shall pay round-trip air ticket between the nearest International Airport to the Teacher�s place applied and Seoul, Korea. Round-trip ticket is provided. One-way air ticket is provided at the beginning and end of contract.
In case the Teacher fails to complete the contract the Teacher shall pay back to the Institute the total amount of the air tickets.
G. Teacher Training
The teacher shall have a training period before starting to teach in their Institute. The period will not exceed two weeks and usually lasts for one week. During the training period, the teacher will be in the Institute for classroom observation. The teacher will receive briefings from the Academic Supervisor, and the Institute Director, fill out the observation forms and will get acquainted with institute policies. During the observation time the teacher will receive half the rate of the regular pay.
H . Vacation
The 10days of vacation will be scheduled as per the yearly academic calendar which is decided by the SLP, (Corp) Sogang Univ: normally the vacation would be in the form of one week in the summer and a few days at the end of the year. The teacher will be entitled to all National Korean Holliday. During the vacation the teacher will be paid the basic rate of payment but no overtime will be paid according to Article 47 and 48 of Korean Labor Standard Law.
I. Completion Bonus
On completion of one�s responsibilities of the full contact period, an additional month of regular salary per one year shall be paid as completion bonus. However, if the teacher does not complete the full period of one-year contract, none of the completion bonus shall be paid according to Korea Labor Standard Law. Completion bonus will be paid by bank transfer no later than one month after the teacher has left the institute. Korean tax will be withheld. Any outstanding debts incurred by the teacher will be subtracted from the completion bonus.
The Institute reserves the right to terminate this agreement for cause with written notification 60 days in advance, and for serious cause without notice. The teacher agrees to give written notification 60 days in advance of intention to terminate this agreement or of interest in renewing it.
I. Period of Contract
Although pay starts the day the Teacher starts Teacher Training Program, the effective date of this contract is the first teaching day not training in the Institute. The total period of this agreement is approximately one year, commencing from the first day of the session and finishing on the last teaching day of the teacher�s 12th teaching session. A delay in the Teacher�s arrival at the Institute, or in the opening of a new Institute may call for a re-negotiation of the contract period.

| I wouldn't sign it. There are all kinds of issues that I can see. In terms of dissecting the contract, I'd wait and see if Grotto comes along and he'll really pick it apart. My guess is he is going to say the same thing. |

21x80=1680 minutes/60=28 hours of in class instruction...a heavy load, add in break time 21x10=210 you come out with 31.5 hours of at the school minimum...not good! now add in that 1 hour a day prep time and you end up with 36.5 hours a week...and climbing!

Bullcrap! who decides whether or not the day was used as claimed? I called in sick because I was ill, tired, sick....no doctors note just a day in bed recovering.

WTF!!!!!!!??? At the end of your contract you will recieve one months pay...regardless of how many days you missed or were late for! SHYTE contract...did I mention that before? So this is above and beyond your completion bonus? Have you noticed how this section makes absolutely no sense whatsoever? No days off you get 500, 1-3 days off you still get 500, oops if you miss 1-3 you only get 400...with dumbass clauses like this you really need to keep looking for smarter employers!

Sounds like they will pad up your classes and then not pay you for the overtime during months where there are national holidays....crappy!

Again...no way! The contract is for one year.....365 days....teaching sessions have absolutley nothing to do with the length of the contract!

You may want to consider changing the above sentence to, "Employment Contract."

The employer's address should be included in the above clause as well as yours.

Teacher obligations should be changed to "teacher duties."

What does tacit mean?

You may work at another school if you have received permission from an Korean Immigration Official.
C. Workload
The teacher will have at least 21 80-minute classes per teaching week.
Teaching 80 minute classes is tough. Teachers normily teach 40-50 minues per class in Korea. You may not get the recess period alloted under Article 53 of the Labor Standards Act with those long 80 minute classes. What happens if you have a national holiday on a Friday, or some other day of the week? This is just food for thought.
Article 53 (Korean Labor Standards Act):Recess Hours
(1) An employer shall allow a recess period of more than 30 minutes for every 4 working hours and more than 1 hour for every 8 working hours during the working hours. (2) A recess period may be freely used by workers.
If the teacher works less than 21 80-minute classes per teaching week, the teacher will be asked to do duties like research and development work under his or her supervisor�s direction.
It would make sense for you to prepare in advance for other classes if no students didn't show for some particular reason.
The teacher may work longer hours during the summer and Winter Vacation.
What does your prospective employer consider to be "longer hours?"

If they want you to show up an hour early that's fine. You should get paid. The purpose of showing up early is to prepare for your classes. All the other stuff will create a heavy workload for you.

Staffs are encouraged to help work out practical solutions to problems at these meetings.
Err on the side of caution when you see "Staff meetings shall be scheduled at the discretion of the Institute Director. Attendance is required." You will not get paid for these staff meetings either. You should get paid for attending these meetings.
The preparation and attendance for special events such as Field Day, Halloween Party, Speech contest, etc. demands the teacher to stay in school for a few days Saturdays in a year and the party itself lasts during the regular school hours.
There could be more special events throughout the year on Saturdays, by how this clause is worded. If you have worked 21-80 minute classes, then you should get paid overtime for each hour.
D. Special Research Projects
Any part of the teacher workload converted to research and development work by the institute will be remunerated according to Section E.
E. Overtime
Over time teaching is paid beyond 21/80-min classes. Overtime will not be paid on holidays, sick days, or emergency leave days. The assignment of overtime above the regular 21classes and less than 25 classes is at the sole discretion of the Institute. The over time rate is 30,000 won per one 80 min class.
F. Work Schedule
The workweek runs from Monday through Friday in monthly periods. The Institute Director will assign the teacher�s schedule. If the teacher has morning classes, teachers will be expected in the institute at least at least 30 minutes prior to their first class. If the teacher have late classes, teachers will be expected in the institute at least 60minutes prior to their first class, Monday through Friday, according to Section C.
It may be a good idea to consider a 2p.m.-8p.m. schedule, or a 3p.m. to 9p.m. schedule when considering a contract. You could definately consider working (X) number of classes per month instead of 120 hours per month. 100 classes would be an ideal amount for you.
The institute director and supervisor reserve the right to decide the teacher�s work schedule as follows:
a Classes begin and finish on Mondays Wednesdays Fridays at 10~7:20.
Classes begin and finish on Tuesdays Thursdays at 10~4:20.
b Classes begin and finish on Mondays Wednesdays Fridays at 10~5:10
Classes begin and finish on Tuesdays Thursdays at 10~7:20
c.Classes begin and finish on Mondays ~ Fridays at 1:30~8:50.
d Classes begin and finish on Monday Wednesday Friday 10~3:40
Classes begin and finish on Tuesdays Thursdays at 10~8:50
It may be a good idea to consider a 2p.m.-8p.m. schedule, or a 3p.m. to 9p.m. schedule when considering a contract. You have set hours, and it makes life slightly easier as you can see.
TEACHER BENEFITS
A. Monthly Salary
The Institute will pay the teacher a total monthly basic salary of each month. The monthly salary is based on a calendar month, not the monthly teaching session. Korean income tax, National Pension & Medical Insurance will be withheld from the monthly salary.
You always get paid the same monthly salary throughout the contract period. There are no areguments about this one padre! National Pension Program is 4.5% of your monthly salary, Medical Insurance is 2.24% of your monthly salary, and these details should be included in you contract so you know how much is being deducted from your monthly salary. One other thing, how much are you getting paid?
B. Housing
The Institute will provide each teacher an apartment / house. The apartment will contain TV, refrigerator, washing machine (or you can use a laundry) , wardrobe, telephone, gas range, bed & Korean style bedding, , and some eating & cooking utensils.
C. Health Insurance
The teacher will be covered by Korean National Health Insurance. According to the government guideline for teachers, the monthly insurance charge will be shared by the Institute and the teacher. Coverage will be from the date of joining to Korean Medical Institute Union, commencing approximately 3 to 4 weeks after the teacher�s arrival of Korean due to requirements of the immigration and taxation department. However, it is not mandatory for foreign teachers.
It is mandatory for teachers with an E-2 Visa!
D. National Pension Plan
In accordance with Korean Law, all foreign workers employed by Korean businesses shall pay into the Korean National Pension Plan at a rate of 9% (or the ratio stipulated by the Korean National Pension Law) deducted against monthly earnings with the employer�s contribution of 4.5%
Refund of the National Pension to a teacher who becomes a compulsorily insured employee, where the Pension Act of the teacher's home country provides the benefit corresponding to the lump-sum refund of the National Pension Plan, the lump-sum refund of this plan shall be paid to the foreigner according to Korean Law.
E. Paid Sick Leave and Emergency Leave
Documented sick leave and emergency leave will be paid for a combined total of five workdays a year.
You should get 3-5 paid sick days and around 7 emergency leave days. They are usually unpaid, though.
The teacher should provide the institute with as much advance notice as possible. Unused sick leave may not be converted into any cash payment. If it is found that the hours/days of absence reported as sick leave or emergency leave were not in fact for such purposes, related costs shall be subtracted from the following month's pay.
The above leaves will be included in the period of medical care compensation according to the Article 78 of Korean Labor Standard Law.
I may be wrong, but Article 78 has been deleted
At the end of he contract period, if a teacher has not taken any days off or missed any days of work he/she will be compensated a total of 500,000 won for his/her faithfulness to his/her job.
If a teacher misses no more than 3, 80-minute classes he/she will be compensated at the rate of 500,000 won.
If he misses 1 � 3 , 80-minute classes he will be compensated at the rate of 400,000 won.
If he misses 4 � 7, 80-minute classes he will be compensated at the rate of 300,000 won.
If he misses 8 � 11, 80-minute classes the compensation is 200,000 won.
If he misses 12 � 19,80-minute classes the compensation is 50,000 won.
But if he misses as many as 20 classes there will be no compensation.
If a teacher exceeds the allocated five days sick leave, the teacher will have 1.5 times the hourly wage deducted from his or her salary for every class missed.
In case the teacher fails to complete the contract the teacher should pay back to the Institute the total amount of sickdays that were used as follows:
If you missed 1~3classes, a teacher will pay 100,000won.
If you missed 4~7classes, a teacher will pay 200,000won.
If you missed 8~11classes, a teacher will pay 300,000won.
If you missed 12~15 classes, a teacher will pay 400,000won.
If you missed 16~20 classes, a teacher will pay 500,000won.
This is illegal!
F. Air ticket
The Institute shall pay round-trip air ticket between the nearest International Airport to the Teacher�s place applied and Seoul, Korea. Round-trip ticket is provided. One-way air ticket is provided at the beginning and end of contract.
In case the Teacher fails to complete the contract the Teacher shall pay back to the Institute the total amount of the air tickets.
Technically this is illegal to, but your going to have a hard time getting this clause removed. It will be a hard fight on this issue.
G. Teacher Training
The teacher shall have a training period before starting to teach in their Institute. The period will not exceed two weeks and usually lasts for one week. During the training period, the teacher will be in the Institute for classroom observation. The teacher will receive briefings from the Academic Supervisor, and the Institute Director, fill out the observation forms and will get acquainted with institute policies. During the observation time the teacher will receive half the rate of the regular pay.
This is illegal. You may not work for pay until you have received an E2 Visa form Korean Immigration.
H . Vacation
The 10days of vacation will be scheduled as per the yearly academic calendar which is decided by the SLP, (Corp) Sogang Univ: normally the vacation would be in the form of one week in the summer and a few days at the end of the year. The teacher will be entitled to all National Korean Holliday. During the vacation the teacher will be paid the basic rate of payment but no overtime will be paid according to Article 47 and 48 of Korean Labor Standard Law.
I. Completion Bonus
On completion of one�s responsibilities of the full contact period, an additional month of regular salary per one year shall be paid as completion bonus. However, if the teacher does not complete the full period of one-year contract, none of the completion bonus shall be paid according to Korea Labor Standard Law. Completion bonus will be paid by bank transfer no later than one month after the teacher has left the institute.
You will get paid your severance pay along with your last monthly salary pay. They won't transfer it to your bank.
Korean tax will be withheld. Any outstanding debts incurred by the teacher will be subtracted from the completion bonus.
This needs to go. You are guaranteed your full severance pay.
The Institute reserves the right to terminate this agreement for cause with written notification 60 days in advance, and for serious cause without notice. The teacher agrees to give written notification 60 days in advance of intention to terminate this agreement or of interest in renewing it.
30 days is plenty!
I. Period of Contract
Although pay starts the day the Teacher starts Teacher Training Program, the effective date of this contract is the first teaching day not training in the Institute. The total period of this agreement is approximately one year, commencing from the first day of the session and finishing on the last teaching day of the teacher�s 12th teaching session. A delay in the Teacher�s arrival at the Institute, or in the opening of a new Institute may call for a re-negotiation of the contract period.
Let me clean up this Period of Contract Clause for ya!
The employer is aware of Korean immigration penalties that will be imposed upon workers who work for any length of time without an E2 Visa. Those penalties could be but not limited to passport confiscation, lengthy interrogations by Korean Immgration investigators, stop work order, daily fines for tourist visa over stay, daily fines for working without a work visa, exit order, deportation, possible incarceration, and re-entry ban preventing return to Korea for one or more years for the worker. The worker will not work for the employer until Korean Immigration has issued an E2 Visa to the worker. After the worker has been issued an E2 Visa from Korean Immigration, the period of employment will begin on __________/__________/__________ and end on __________/__________/__________. The the worker will work for the employer for a period not exceeding one year.
The period of this contract shall be one (1) year

I made the mistake of working in a school with a similarly crappy contract and let me tell you... I regret it EVERY day. Someone on this board once said you can tell a good hagwon from a bad hagwon just by looking at the contract, and this one SUCKS
Having worked in a crappy Hagwon, I feel it's my duty to say this:
