I'm wondering what exactly would happen to a teacher who gets caught by immigration working on a tourist visa while their visa being processed and before they get the chance to do the visa run ..

Probably nothing...as your visa is being processed. I mean, img is there in one respect to help Korean employers, why would they stab them in the back? Very Happy

Letter to

US Immigration Service

Dear Sirs

I am a Brit in your country on a tourist visa although I have applied for a work visa.

If I start work before you issue the working visa, and you do not find out, is that OK?

Is the answer different if you do find out?

A prompt response would oblige.

Very truly yours .... etc etc

If you don't have a visa in your passport and you're working here you could get fined and deported. Your visa isn't 'being processed' until it's at an embassy outside Korea. Don't work without one unless you're prepared to face serious risks.[/i]

Being processed means that you are working illegally. Smile

I'm not high and mighty...but...why would anyone want to break the law in a country that is not "theirs?" I'm confused.
If one is caught...chances are very good that they'll get deported.

Fined, deported.

Unless your boss pleads your case and you get a friendly immigration officer.

The hagwon owners are sneaky little bastards. They'll just claim you were/are undergoing training or bribe immigration. Problem solved.

It happened to me. I was caught by immigration while my working visa was being processed. I was blacklisted from Korea for three years and fined 500,000 won, which my director paid.

Before I read your post I was going to say that it happens 50% of the time and that's probably a low estimate. I still believe that!

The reason it happens is two/three-fold. First, the hagwon wants to test you out before they hire you legally/sponsor your visa. Secont, for the newbies, they usually don't know the legalities. Third, the seasoned teacher accepts this because if they don't they won't be hired or chosen if they refuse to work before getting the E-2.

How/Why do you think you were caught? Where are you now/When did it happen?
