One of my friends on another forum, Zazm, has asked me to get some help from people on this forum.

Though it is not about Korea in nature, but I told him that the people here tend to be more helpful than on other sites.

Well....here it goes.....

He got married last summer while doing a summer camp in China and got her (surprisingly) a tourist visa to the US.

Now, he wants to have a ceremony in the US for the benefit of his parents. But he is wondering if the marriage certificate would allow her to change her status in the US.
Although they have a marriage certificate for China, he would like to renew his vows while in the US and allow her to stay there with him.

I know this is done with people married to Koreans (2 ceremonies, one in Korea and one in their homecountry) with little to almost no problems, but again, she is not a Korean.

Has anyone been through this situation before? If so, what were your experience with this?

Zazm says he is leaving for the US in a few days and would love some advice as soon as possible.

Any advice would be greatly appreciated...thanks in advance...cheers~!

He helped me out more than once and I would love to pay back the favor (with your help)

This question gets asked about a million times a year on the immigration forums.

If she has a TOURIST (temporary visitor visa) for the US AND she is already legally married she will HAVE TO leave the US to apply for her K3/CR1 immigrant visa.

She will NOT be able to do her AOS from tourist to immigrant inside the country (USA). Lots of reasons why and to detailed to get into here.

If she violates the terms of her current visa and ends up in an overstay or other illegal position she will be subject on discovery to arrest, detention, deportation and a 10 year to life ban on re-entry.

The UCSIS has seen just about every kind of shortcut attempt to circumvent their policies and they are VERY STRICT about it. Try to cheat and you will get burned. (statement of fact not meant to sound holier-than-thou)

Sorry to be the bearer of bad news....

Processing time for wife visa from China takes about 8 months. Start now or face a LONG separation later.
