I failed to see my strong suit. I don't know Korean law but I know American law. When he got his license to practice in the US he had to sign and file a document with the courts subjecting him to the discipline of and jurisdiction of the American Bar Association over his license. I simply told him that I was filing a complaint with the ABA and requesting that the Ethichs Board subject him to fines, suspension or revocation of his license.
If he fails to answer I win by default. If he does answer it will cost him a great deal of money.
He also has to worry about the Ethical Code of the Korean Bar Association. Same deal. I threatened to turn him in.
His wife handed in false vouchers at SNU and I adviced her that I was going to have the University investigate the vouchers.
Why learn the law when there are regulatory agencies that enforce the laws. They did not fear me, but they faced the shame of investigation...and the cost.
He signed a release for the key money & a million won to get home. I signed a release for any and all causes of actions and agreed to take no action unless under court order to provide information.
Licenses, degress and diplomas are gold here. Instead of researching, I merely told him I would contact the ethical committees that actually have jurisdiction over him. Why re-invent the wheel.
If any of you find yourself in a jam like this, find out who regulates the offender and go to them. They are paid to do the legwork. I should know, that was my job in the US.
I still think that many of the young students here, though naive, have good hearts and are a good people. For the most part this country has been a pleasant learning experience. Just watch out for the "old order" who are used to entrenched power and the presumption of superiority. The old caste system is weakening, but it still has a grip.

Good insite. I figured a lawyer would find out for himself what he needed to do for his legal situation.
FYI, you didn't have to sign any release letter. It is his responsibility to provide you with a return airfare in this type of situation. As for the key money, that's his problem and not yours. He didn't do anything special for you.
Once you get home, make sure to inform SNU as well as any of the authorities you mentioned. Some people need to learn a lesson. I think you learned your lesson. You have to do your own research and check into the laws yourself before you plunge in and trust everyone who SEEMS trustworthy. Don't trust anyone, especially in KOREA! Remember that! On top of that, never trust anyone with money! An old boss told me that once. It's so true. |
