Huh? What are you doing writing a law review article for a guy who speaks zero Englishee?
Conditions of Sevice
1-----A prepaid air ticket assigned in my name only and in my physical custody (non

Fair is fair. Don't they all advertise round-trip flights?
2---- A pre-signed employment release letter from your company and or
school, held in my physical custody.
If I saw this, I would think "planning on leaving?"
3---- Physical proof of accommodations to be used by me only. (No shared quarters or
bathes). Physical proof shall be obtained by photos and supplied by your company

Simplify brah. Just write "Pictures of accomodations, proving that they are for one person only.
4---- All means and reasons of travel to and from your company and or school shall be
covered by your company and or school. Reimbursement shall be covered daily by
your company and or school.
Why would you travel? Is this an in-house job going from business to business? If not- if you're just commuting to work and home- a metro ticket costs less than a dollar. Why worry it?
5---- I shall not except any form of Bonuses that are intended or worded in any manner
and or to be considered special pay for completion of services by your company
and or school.
I have zero idea what you just said. Also, it's "accept", not "except" and a teacher who doesn't know the difference has no business teaching. If I were hiring, I would have pressed delete at this point.
5b--- All such mentioned Bonuses will be added per month to my salary until
completion of said services agreed upon by me and your company and or school.
You want the bonus and severance (two distinct items) broken down into monthly increments. I'm on board with this since I know few people who actually got the bonus and severance they were owed. So say "Bonus and severance pay should be clearly indicated in my contract and added to my monthly salary in 1/12th increments.
6---- All manners regarding income obtained thru my services and paid by your company
and or school shall be in a check payable to me and showing all government
deducted taxes at all levels of government during the length of my services with
your company and or school.
Huh? Just say "A salary of XXX is due on the XXXth day of each month and must be accompanied by a pay stub listing all applicable deductions."
7--- At no time will your company and or school posses or hold my passport,
visas and or educational documents deemed ORIGINAL or MASTER by
me. If your company and or school requires signed and or notarized transcripts from
my university or other ex employers, your company and or school shall bear all
financial burdens in obtaining these documents. I will supply addresses and
authorization letters.
Again, I'm on board. Many school want to blackmail you by playing hide and seek with documents. Don't allow it.
8--- I shall in no manner regarding financial burdens deemed HIDDEN COST not
covered or mentioned in a contract between your company and or school with me be
held accountable towards my salary.
What? Just say what you did about deductions in #6
9--- At no time shall my working conditions, environment, hours, schedule and or
locations be changed without my expressed approval in writing. Your company and
or school will be allowed to make temporary emergency changes due to illnesses or
lack of teaching staff that may last up to 5 working days working days are
Monday thru Friday without warning. Any other changes lasting more than 5
working days must be approved by me.
Maybe Korea is not for you. Better to say that you must be paid XXX sum per teaching hour over 20-25 hours a week.
10---Your company and or school shall hold the same rights as me regarding termination
of services, be it written or verbal with or without notice.
A Gentlemans agreement will be offered pertaining to but not limited to
Termination of Services by either party. This Gentlemens Agreement will be
in acted between me and your company and or school covering all areas of legal
and or morality regarding treatment and honorable respect towards each party.
This Gentlemans agreement covers only the area of Termination without
notification in writing 30 days prier to termination of services between me and your
company.
You mean "each side may terminate this contract by giving no less than 30 days' prior notice", don't you?
12---Any violations of implied wordings and or meanings will be deemed suitable
grounds for immediate termination of services by either party.
Trust me. You really don't want this.
If you feel you can honor my conditions then we can begin working together.

Thank You

Yelman or Gary Hilburn,
I read over your list. Twice. It's unbelievable. There is not one item on your list that would be accepted by any employer anywhere. Where did you get the idea for such demands?
I do hope you will send this list to every employer of English teachers in Korea. It will show them just how reasonable most of us are and how lucky they are to have us. After all, they could have you.
Really now. You should spend more time reading and learning and less time posting here on Dave's. Many reasonable contracts have been posted here on Dave's. None of them have any of the things you are asking for.
If you really want to come to Korea to teach English, earn some money and save a lot of money, you have to understand that there are no guarantees in life and you have to take some risks. You have to have some humility and courage. You have to respect the culture you are coming to. You have to be reasonable. |

i think i get the drift in here about teaching in korea.
i dont need you to tell me what working condition i desire....now do i?
and for your information..i have used this basic format in my English company in Thailand......no schools refused it......perhaps you dont require much...
ill run the risk of living in the US before ill be screwed in Korea. |

You're not going to get any of that shit. So if you're going to be smoking crack and dreaming...you might as well dream big. |

Any school that hired you, Yelman, would be the worse off for having done it.
You can neither spell well nor write well. You seem barely literate, in fact, so what deludes you into imagining that you have anything to offer any ESL students?
S.F.A., that's what! |

You guys are nuts! Most of the things this is asking for are not only reasonable...some of them are law. I know many of you guys think you have to settle for 1.7 or 1.8 and being treated like some subhuman serf, but if that's your situation...you LET it happen to you by not asking around and buying into rediculous work conditions.
He DID stipulate some of these things are wishful thinking, but since you will no doubt be an E-2 visa holder...I think you're over-estimating your leverage as a first-year teacher, unless you've got credentials up the ying-yang. In that case, you should have no problem getting everything you've indicated. I've known several people who have done the same thing. Anyone who shares accomodations with someone they don't know or like, works for less than 2 million, and lets someone have custody of their documentation is a sucker and is in need of some serious guidance.
The letter of release clause is way off base. Never happen.
Plus, you have to understand that contracts are nothing more than informal "guidelines" that most foreigners take for legally enforcable documents...bait traps with cheese for mice, bait traps for naive whities with contracts. |
