My job situation has grown progressively worse and I am thinking I may need the services of a Korean Lawyer.
Any suggestions?
Hopefully one that speaks some English might be avaliable. |

Go to efl-law.org/forums, they should be able to hook you up. |

I doubt they'll charge you to pose a question or two. |

The British, American, and Canadian embassies have lists of English speaking lawyers on their websites. Marc the lawyer on the sight that rhymes with rectum is also an excellent source of advice. |

Sorry royjones but I already discussed my problems on another thread. I really feel this is beyond the realm of a dave's posting and more the area of a lawyer. |

No the time I got hit by a car in front of Kermo's church(which she never showed up to either and good thinking on her part the sermon sucked) has nothing to do with why I am considering a lawyer now.
It has all to do with my rather dodgy school and their rather weak attempts to threaten me with not giving me a letter of release unelss I comply with all their demands. |

I'm wondering if your employer fits within Article 7 of the Labor Standards Act?
Article 7 (Prohibition of Violence)
An employer shall not resort to violence or batter a worker for the occurrence of accidents or for any other reason. |

Why don't you give them a 2 months letter of resignation. Date it and have them sign it. After two months they have to give you the release letter OR contact the immigration office and make a claim..
Have u already done that? |

Let me give you some advice through my shared experience. Take from it which you will. If you want to go through with it you must be ready for the long haul and have money and/or guts of steel. I have been in the Korean courts for almost 2 years. I did not hire an Attorney and wouldn't ever do such a thing unless I was in dire straights which compared to yours my situation is/was.
Do you trust Attorney's? Do you trust Attorney's from your home country? Would you trust a Korean Attorney? Would you trust a Foreign Attorney working with you while he worked for a Korean Attorney law office? Do you think any Attorney would really care about you or your case?
I was provided a Criminal Court Attorney "for free"(only after I learned that I could ask and they would provide) and on the last day in court he did not attend the proceedings. He skipped out! He did not protect my rights. The Interpreter told me wrong information about the next step saying I would get an instruction letter in the mail by the court concerning payment of fines/appeal deadlines. Guess what? I never received anying in the mail. This was at the appellate stage. The 3 Appellate Judge's didn't instruct the Interpreter to tell me the courts rules nor did they care if the court appointed Attorney attend court. I'm sure he got paid though.
I called/went to a number of Attorney's listed on a Foreign Embassy website. One in which I visited told me he didn't represent employees, only employers. This was all after I had already won the decision at the Labor Ministry. I contacted my Embassy and suggested they remove a certain Attorney from their website. They did not do it.
Next, I will contact my elected official from my home area to share with them the saved e-mail sent to me from my embassy in which they even directly gave me contact information to the exact Attorney I had already visited.
There are plenty of Attorney's listed on the embassy website but my embassy suggested a specific Attorney's office which would not help me because I'm sure I am "only" a Teacher.
The lousy Attorney suggested it would take years and cost up to $40,000
He suggested I quit the legal process in Korea and go elsewhere such as China or Thailand to teach/get girls. I think the guy was more than scum.
He could be correct about the years since my case could be appealed again in Civil Court for the 2nd time, the next time would be to the Supreme Court.
Good luck though! |
