Employment Contract
Base Salary:2,200,000 won/month
Period of Employment: One year, from Aug 1st, 2006 to July 31st, 2007
(Upon mutual agreement, The period of employment may be extended)
Cornerstone International School employs the Instructor and the Instructor agrees to work for this Employer under the following terms hereby agreed on by both parties.
1. Conditions of Employment
A. The Instructor's standard schedule will be 30 hours of classes per week or less, Monday to Friday. The instructor will be required to work some Saturdays per year, but will be given at least 2 weeks notice prior to the working date. (for example: 1 July day and 1 December day (Christmas break and July summer break) of elementary classes are "made up".) No kindergarten classes are held at this time.
B. During the training period the Instructor will be a training wage. This wage will be 7,000 won per hour.
C. Over time wage will be 15,000 won per hour.
D. In addition to the scheduled class hours, the Employer reserves the right to designate one hour per week from the Instructor's schedule for mandatory meetings or teaching seminars.
E. The Instructor is expected to prepare for his/her classes, evaluate student's work, prepare grades and evaluations, and fulfill other responsibilities of a competent English teacher on his/her own time.
F. The Instructor is expected to follow any rules or regulations set by the Employer. This includes, but is not limited to: submitting grades in the appropriate manner and at the appropriate time, giving evaluations scheduled by the Employer, following evaluation criteria set by the Employer, etc
G. The Instructor will follow the dress code issued by the Employer. The Instructor must wear professional attire and present him/herself favorably while teaching classes.
The dress code is a as follows: the instructor should wear neat, clean attire, (IE. High school teacher "casual Friday" wear). Ties and button-down shirts are not necessary on a daily basis. For example, a nice "polo" style shirt, "dockers" type pants and good shoes will suffice. No revealing or short attire is acceptable. No short shirts that show your stomach. Summertime wear can include shorts and polo shirts (no t-shirts). The shorts need to be walking style, just above the knee. No tank tops, sleeveless shirts or spaghetti straps, Sandals are acceptable in summer, but should be sport style (around the heel strap). No Flip-flop styles. If your attire is not acceptable, the supervisor reserves the right to send you home to change into something more appropriate. A few times a year professional attire (dressy) will be necessary. Events such as graduation, start of year ceremonies, Drama Festival, Open House...etc. will need nice clothing. At these times you will be seen by many parents.
H. This Employer expects the Instructor to follow a standard of conduct corresponding to that of a Kindergarten & Elementary teacher. The Instructor is expected to maintain professional relationships with other staff members and students. If the Employer finds evidence implicating the Instructor in teaching while intoxicated, having a sexual relationship with a student, committing an act of sexual harassment, or any other act violating this standard of conduct, the Employer may terminate the Instructor's contract immediately. I. Korean visa regulations prohibit the Instructor from accepting pay from any individual or organization other than the Employer.
J. The Employer is obliged to provide all the necessary forms and guarantees for the Republic of Korea visa application.
K. Upon the mutual agreement of the Employer and nstructor on a subsequent contract, the Instructor's period of employment may be extended. The Employer will approach the Instructor and give 60 days notice if the Employer would like to extend the instructor's contract. At the beginning of the second contract the instructor's monthly salary will increase by 100,000KRW

2. Compensation
A. The Instructor will be paid the agreed monthly salary on the last day of each month: or if the last day is not a work day, the Instructor will be paid on the last working day before the end of the month. Any overtime salary the Instructor may have earned during the previous month will be added to this base salary. Korean income tax and National Pension contributions are subject to annual refunds.
B. Severance Pay: Upon the successful completion of 1 year contract with the Employer the Instructor will receive severance pay in compliance to ROK's labor laws. The severance pay will be 2,000,000 won.
C. Taxes and Pension: Taxes and pension payments will be deducted from the Instructor's income in accordance to ROK law. Monthly pay is taxed, and the taxes will be deducted as income tax and residence tax on a monthly basis. The employer pays 50%of the pension. premium and the Employee pays 50%. The Employer will help you apply for tax returns at the appropriate times of year. When you Leave the country, you can apply a lump-sum refund benefit from the National Pension Corporation and receive all your pension payments back. For more information go to http://www.npc.or.kr
D. Health Insurance: The Instructor is required to subscribe to the National Health Insurance plan. Health insurance is also split 50/50, 50% is paid by the Employer and 50% is paid the Instructor.
E. Airfare: The Employer agrees to provide the Instructor with a round-trip airfare from the closest International airport to the Instructor's place residence. If the Instructor is currently residing in Korea, the Employer agrees to provide the Instructor with a round-trip flight from Korea to any city in Japan(Employer's choice) with a Korean consulate. If the Instructor terminates his/her contract prematurely, he/she must repay the cost of the ticket to the Employer, as follows: the Instructor terminates his/her contract after 6 months- 50% of the cost of the ticket. In such a case, this repayment will be deducted from his/her paycheck.
F. The Employer grants the Instructor paid sick leave for up to 3 days only for serious illness or extreme personal emergency, provided the Instructor gives the Employer a doctor's note when they return to work. A least 2 hours notice (or before 9 AM of that morning) must be given to the head teacher or relevant supervisor. absences without a doctor's note will be deducted from his her paycheck on the basis of the overtime rate of 15,000 won/hour.
G. The Employer will provide the Instructor a single housing. The housing policies are as follows:
1. the Instructor is responsible for any bills that pertain to the months of his/her residence. This includes apartment management bills and gas and gas bills. Telephone lines are provided in the apartments by the employer. The Instructor is responsible for paying any telephone bills that may ensure.
2. The Instructor will pay the Employer a 200,000 won security deposit for the apartment provide by the Employer. This deposit will be deducted from the Instructer's salary on the first and second month of the Instructor's contract period.
Upon the completion of the Instructor's period of employment, the Employer will use the Instructor's security deposit to pay the Instructor's responsibility of the monthly bills at his/her apartment for his/her final month of residence. In addition, the security deposit will be used to pay for any damage or cleaning expenses after the Instructor moves out. The remainder of the security will be refunded to the Instructor. This may take up to 3 months due to the way the Korean bill system works.

3. Termination of Contract
A. The Instructor shall commence his/her employment on the date specified on this contract. The Instructor will continue his/her employment until the completion of the contract period, unless the contract is terminated sooner as provided herein.
B. If, as a result of negligence or intoxication, the Instructor damages facilities, materials, or other property belonging to the Employer, or causes damage to the image of the Employer, the Instructor shall assume pecuniary Liability in accordance with Korean law.
Furthermore, the Employer has the right to terminate this contract at the time of the violation without further compensation or responsibility to the Instructor.
C. The Employer reserves the right to revoke this contract at any time if the Instructor is found to have breached the contract. In this case, the Employer will only pay the Instructor the wages that have been eared up to that point. In such a case, the Employer is not obliged to give any notice. The employer may report the Instructor to the Ministry of Justice so that the Instructor's visa will be revoked. The Instructor then
has two weeks to leave the country.
D. If the Instructor seeks release from this contract, he/she must do so in writing at least 45days prior to the Instructor's requested date of termination. As explained earlier, the Instructor must repay the Employer for any money given as a reimbursement for airfare. In this case, the Instructor forfeits all pay, including severance pay, except for wages that have already been earned up to the date of termination. The Instructor must also give the Employer any records of grades and attendance for all of his/her classes for the current or previous semester.
E. If the Instructor terminates the employment without providing the required written notice to the Employer, the Employer may reserve the right to withhold the Instructor's security deposit and any wages earned by the Instructor but not yet paid by Employer.
F. If necessary in the event of a national emergency, the total incapacity for business of either party, or the Employer ceasing to carry on business, this contract will terminate.
G. The Employer may terminate this contract at any time because of the Employer's dissatisfaction over any violation of the instructions or rules of the Employer, or the failure of the instructor to comply with any one of the agreements contained herein.
H. The Employer may terminate this contract if the services rendered by the Instructor are not satisfactory to the Employer. The Employer shall be the sole judge of such satisfaction. Services considered include, but are not limited to, adequate class preparation, the effective presentation of class lessons, and the ability to work professionally with other staff members and the language institute administration. The Employer may reserve the right to have the instructor's students evaluate Instructor. The employer may use the results of this evaluation to make the decision to terminate the Instructor's contract.
3. Acceptance of Contract
Both parties have read the above conditions and agree in good faith to the terms contained herein. |

Korean Holidays?
Vacation?
Housing?
Severance should be 2.2 million, the same as the monthly pay.
OT is too low. Should be 20,000 minimum.
Training should be at the regular monthly rate.
Saturdays: there are reasons and times that working on a Saturday could be OK, but your contract is completely open ended about this. No way.
Needs a lot of work. |
