Haha . Sorry.

No one has to answer but I'm sure there are some grizzled veterans here who can show the fresh faced recruit what's what with these predatory contracts. Anyway I got offered a contract from NetKorea for a public school in Bucheon. The schools are :

1. Sangji elementary school

Although I have heard bad things about recruiters it [/i]seems most people don't have outright terrible things to say about NetKorea and at least its a public school. I graduated school two months ago with a History and Religious Studies major and I have no official teaching experience or certification beyond tutoring and such. Anyway, here goes the contract - tear it up guys.




한민국 경기도교육감(이하 �고용자�라 한다)과 캐나다 국민이며 일본 에 주소를 둔 원어민강사 (성명)

(name removed) (이하 �피고용자�라 한다)는 경기도교육청의 원어민보조교사 초청�활용 사업을 위하여 다음과 같이 고용 계약을 체결한다.

This Employment Contract (hereinafter this �contract�) is made by and entered into between Superintendent of the Gyeonggi Provincial Office of Education(GOE), the Republic of Korea (hereinafter �Employer�), and the native English teacher, (Name) Daniel Soedirga (hereinafter �Employee�) a (an) Canadian citizen residing at Japan.

제1조(목적 및 고용등급) 고용목적과 고용등급은 다음과 같다.

1.(목적) 이 고용계약서는 경기도 초등학교에서 영어를 가르칠 영어 보조 교사의 직무와 고용 조건에 관한 사항을 규정함을 목적으로 한다.

Article 1-1(Purpose) This contract is made for the purpose of setting forth the terms and conditions of employment for teachers who will teach English at a school in Gyeonggi-do schools.

제2조(임무) 피고용자의 임무는 다음과 같다.

1.경기도교육청에서 지정한 초등학교에서 영어보조교사로서 협력교사와 함께 영어를 가르친다.

2.협력교사와 함께 영어수업을 설계하고 교수학습자료를 제작한다.

3.영어교육 관련 특별활동, 교사 연수, 영어캠프 등을 지도한다.

4.영어교육과 관련된 기타 활동을 지원한다.

5.교사, 학부모, 학생들을 위한 영어회화를 지도한다.

6.교육감이 실시하는 영어캠프와 교사연수에 적극 참여한다.

7.고용주가 지정한 기타업무를 수행한다.

Article 2(Duties) Employee shall perform the following duties.

1.To teach English as an assistant teacher at an elementary school in Gyeonggi-do

2.To do lesson planning and develop teaching materials with a Korean co-teacher.

3.To be involved in extra-curricular classes, teacher training, or English camps requested by the school.

4.To be involved in other activities relevant to English teaching

5.To conduct English Conversational Class(es)/course(s) for Korean teachers, parents, and students

6.To be positively involved in a teacher training program and a English camp designed by superintendent.

7.To perform other duties as designated by Employer.

제3조(지휘 감독) 피고용자는 고용자가 지정하는 소속기관장의 지휘감독을 받아 제2조에서 정한 임무를 행한다.

Article 3(Supervision) Employee shall perform the duties specified in the foregoing Article 2 supervised by Principal of your host school designated by Employer (Superintendent).

제4조(고용기간) 고용기간은 2006 년 5월 3일부터 2007년 5월 2일까지로 한다.

Article 4 (Term of employment) The term of employment shall begin on May 3rd, 2006 and end on May 2 , 2007.




제5조(항공료 및 사직)

1.피고용자의 입국항공료는 피고용자의 입국후 고용자가 피고용자의 거주지역에서 한국 인천공항까지의 최단거리를 기준으로 한 3등석 항공요금을 대여한다.

a해외거주 후보자�피고용자 거주지역과 인천공항과의 최단거리 항공료가 제공된다. 항공료 지급은 한국에 도착한 후 편도요금이 지급되고, 계약완료 후 귀국 항공료가 지급된다.

b.국내거주 후보자�비자 발급을 위해 한국에서 최단거리 외국 방문 왕복 항공료가 제공되고, 계약완료 후 본국 편도 항공료가 지급된다.

2.만약 피고용자가 부득이한 사유로 고용기간 중에 사직할 경우에는 60일이내에 사직 일자와 사유를 서면으로 고용자에게 통보하여야 한다.

3.피고용자가 사직하는 경우에는 귀국항공료를 피고용자가 부담하며, 피고용자의 비자는 취소된다.

4.피고용자가 부득이한 사유로 고용기간 중에 귀국할 수 밖에 없다고 고용자가 인정할 경우에는 귀국항공료를 제공할 수 있다.

5.사유의 여하를 불문하고 고용계약 개시일로부터 6개월 미만에 본 계약이 조기에 종료되는 경우 피고용자는 계약 종료 즉시 위 대여금의 100%를 고용자에게 반환한다. 피고용자가 고용기간 개시일로부터 6개월 이상 근무하는 경우 본항에 의한 대여금의 상환 의무는 면제된다.

Article 5(Airfare and Resignation)

1.The airfare for Employee�s flight, actual purchasing price, to Korea shall be reimbursed by employer based on an economy class airfare of the most direct flight available from his/her permanent residence to Incheon International Airport.

고용자(Employer�s Signature):_______________ 피고용자(Employee�s Signature) ________________

a.Teacher residing outside of Korea: The Employer shall pay for airfare between the nearest international airport from the Employee's place of residency and a Incheon International Airport in Korea. Airfare will be paid in the following fashion:

A one-way ticket to Korea will be reimbursed after Employee�s arrival in Korea and after the completion of the employment contract a one-way ticket to the airport of departure will be provided

b.Teacher residing in Korea: Teachers hired in country shall have the visa trip to the nearest country from Korea (round-trip airfare) reimbursed by the Employer. After the completion of the employment contract a one-way ticket to the Employee�s foreign residence will be provided.

2.If Employee should decide to resign during the Term of Employment, he/she must give Employer a sixty (60) day prior written notice of resignation stating a date of and a reason for resignation.

3.In the case of Employee�s resignation, the airfare for his/her return trip shall be borne by Employee, and his/her visa shall be cancelled.

4.In the event that Employee return home before completing the contract for reasons beyond his/her control, the airfare for his/her return trip may be provided by Employer.

5.In case of the termination of this Contract within six(6) months, Employee shall immediately pay back 100% of the one-way airfare to Employer. If Employee works more than six(6) months during the term of employment, Employee�s obligation to pay back the airfare shall be waived by Employer.

제6조(근무지)

1.피고용자는 고용주가 지정하는 경기도내 초등학교와 지역교육청에서 근무하는 것을 원칙으로 한다.

Article 6(Work Place)

1.Employee shall work at a local elementary school and a district office of education designated by Employer.

제7조(근무시간)

1.피고용자는 일일8시간(점심시간 제외), 주 5일을 근무하며, 토요일, 일요일 및 대한민국 휴일에는 근무하지 않는다.

2.피고용자의 근무시간은 대한민국 공무원의 출퇴근 시간을 준용하되, 소속기관장이 정하는 바에 의해 조정할 수 있다.

3.피고용자의 정규 수업 시간수는 22시간을 초과하지 않는다. 소속기관장은 피고용자에게 초과 수업을 요구할 수 있으며, 주당 6시간 이상을 요구할 경우 피고용자의 동의를 얻어야 한다.

4.고용자는 피고용자에게 초과수업 수당을 지급해야 한다. 피고용자의 수업이 22시간을 초과할 경우 피고용자는 시간당 20,000원의 수당을 받을 수 있다. 피고용자는 초과수업시간을 기여휴가로 사용할 수 있으며, 이 경우 1시간의 수업은 휴가 1시간으로 계산된다. 기여휴가의 경우 8시간의 초과수업은 하루로 계산된다.

Article 7(Work Hours)

1.Employee shall work eight (Cool hours per day (excluding lunch hour) for five (5) calendar days per week from Monday to Friday and shall not work on Saturdays, Sundays and Korean national holidays.

2.The Work Hours of Employee may follow the normal work schedule of civil servants of the Korean Government; however, such Work Hours may be adjusted by principal as he/she deems appropriate.

3. Employee�s regular teaching hours shall not exceed twenty-two (22) hours per week. Employee may be asked to teach some extra classes. Extra teaching should not exceed 6 hours a week without Employee�s consent.

4.Employee shall be paid for the extra working hours. If Employee�s actual weekly class instruction hours exceed twenty two(22)hours, Employee shall be entitled to a supplementary class instruction pay of 20,000Won per hour. Contribution leave may be requested in place of overtime pay. Contribution leave will be calculated as one hour of paid leave for each hour of extra class taught. In case of contribution leave, eight extra classroom hours will be calculated as one day.

제8조(보수)

1.피고용자의 보수는 매월 한화 180 만원이며, 대한민국법에 따라 소득세와 국민 연금 기여금을 원천 징수한다(캐나다를 제외한 나라의 원어민은 최초 2년간 면세혜택이 주어지고, 미국인과 캐나다인은 연금을 귀국시에 환급받을 수 있다).

2. 원어민의 지위와 관련하여 1등급(230만원), 2등급(200만원), 3등급(180만원)으로 계약하여 채용한다.

3.보수는 매월 25일에 지급한다. 만일 이 날이 근무일이 아닌 경우, 그 전날에 지급한다.

4.피고용자의 근무일이 한 달이 안 될 경우 근무 개시일 또는 종료일에 따라 일할 계산으로 보수를 지급한다.

5.피고용자가 사전 허가없이 무단 결근하였을 경우에는 결근일수만큼 일할 계산하여 보수에서 공제할 수 있다.

6.피고용자의 1년간 계약이 만료되면, 1년에 대하여 30일분의 평균임금을 퇴직금으로 지급한다.

7.피고용자는 본 계약에 규정된 보수이외는 일체의 다른 보수를 청구할 수 없다.

8.1등급 원어민이 재계약을 체결할 경우 보수는 경기도교육청의 교육목적에 부합한 교수 능력과 실적, 공헌을 평가하여 인정될 경우에 한하여 인상될 수 있다. 1등급 원어민에 대한 봉급 인상은 100,000원을 초과할 수 없다.

Article 8(Salary)

1.Employee shall be paid 1.800.000 won per month. However, the Korean income tax(*exempted for the first two employment years with the exception of Canadians) and the national pension contribution (*refundable for only Canadian and US citizens) as required under Korean law shall be withheld each month from Employee�s salary.

2.Regarding status of employment: Employee shall be hired pursuant to this Contract as a _

_1st level (Pay: 2.3 million won monthly) English Language Instructor(ELI)/__2nd level(2.0 mill)/_*__3rd level(1.8mill).

3.Employee�s salary shall be paid on the 25st of each month. If this day falls on a National Holiday, Saturday or Sunday, the salary will be paid on the immediately preceding business day.

4.When Employee has not worked a full month, salary for that month shall be paid on a pro rata daily basis either from the first day or until the last day of work.

5.If Employee should be absent from Work without a prior approval, his or her salary for that month shall be deducted by the amount calculated on a pro rata daily basis for the number of unauthorized absent days.

6.Upon completion of a one-year contract, Employer shall pay Employee thirty(30) calendar days, average wage as a severance pay for Employee�s continuous employment of one year.

7.Employee shall not claim against Employer any compensation and/or payment other than those provided for in this Contract.

8.1st level Employee whose contract is renewed for a second term or subsequent terms, may be eligible for an increase in salary. The increase is not automatic and will depend, in all cases, upon the Employee�s teaching performance and contribution toward the achievement of the educational goals of Gyeonggi-do Office of Education. Pay increases for 1st level instructors shall not exceed 100,000 won for every subsequent teaching year.

제9조(계약만료)

1.제4조에서 정한 고용기간은 피고용자와 고용자간의 합의에 의하여 1년(12개월)단위로 재계약할 수 있다.

2.본조 제1항의 규정에 의해 재계약을 체결하는 피고용자에게 14일간(주말 및 공휴일 포함)의 고국 방문 휴가를 제공하는데, 이는 계약기간 중 제공되는 유급휴가 외에 추가로 제공되는 혜택이다. 고국방문휴가는 고용기간 만료 전이나 후에 학기중 수업에 영향을 주지않는 여름 방학 기간을 사용해야 한다.

3.재계약을 체결한 피고용자가 고국을 방문하는 경우 한국과 피고용자 본국 거주지역까지의 최단거리 국제선 3등석 왕복요금(국내선 제외)을 제9조 제4항에 따라 지급한다. 피고용자가 본국을 방문하지 않을 경우에 본국 거주지역 까지의 최단거리 국제선 3등석 왕복항공요금(국내선 제외)을 제9조 제4항에 따라 지급한다. 본국을 방문하지 않고 다른 지역을 방문할 경우 본국방문비용을 초과하지 않는 범위내에서 왕복항공권을 제공받을 수 있다. 본국을 방문하지 않고 한국에 있을 경우 본국 방문에 해당되는 왕복항공료를 현금으로 받는다.

4.피고용자의 고국방문을 위한 왕복항공료는, 피고용자의 입국 후 고용자가 피고용자의 거주지에서 가장 가까운 공항에서 한국 인천공항 까지의 최단거리를 기준으로 한 3등석 항공요금 상당액(정상요금의 75%이내)을 대여한다.

5.피고용자가 고용기간의 근무를 마치고 10일이내에 한국을 떠날 경우, 귀국항공료를 지급 한다.

Article 9(Contract Completion)

1.The Term of Employment stated in Article 4 may be renewed by a mutual written agreement between Employer and Employee, provided that each renewed employment term is one(1) year.

2.In the case of renewal of this contract pursuant to the foregoing 1, Employee shall be given a two-week (weekends and holidays included) home leave which is extra, beyond the 14 days vacation. Home leave should be taken in the summer vacation just before or just after the contract year is up.

3.In the event Employee travels to his/her home country pursuant to the foregoing 2, Employee will be given a free round-trip ticket. The round-trip airfare for Employee�s flight shall be based on the rate provided for in 4 hereafter. In the event employee does not travel to his/her home country pursuant to the foregoing 2, Employee will be given the amount of money equivalent to the round-trip airfare to the different location(expense of this travel fare must be less then the fare of homeland visit) he or she may embark to during their home leave period or if member decides to stay in Korea during this period, the employee will be given the amount of money equivalent to the round-trip airfare to their homeland..

4.The round-trip airfare for Employee�s home leave shall be loaned by Employer based on an economy class air-fare(less than 75% of the regular price) of the most direct flight available from Incheon to the airport nearest to Employee�s residence.

5.If Employee completes the Term of Employment without the intention to renew and leaves Korea within 10 days from the expiration date, Employer shall pay for Employee�s one way return flight.

제10조(주거)

1.고용자는 피고용자에게 주거를 제공하되, 도보로 출퇴근이 가능하도록 학교에서 가까운 지역의 주거를 확보하도록 최대한 노력해야 한다.

2.주거의 형태는 임대주택, 기숙사, 또는 아파트를 포함하나 이에 한정되지 않는다. 독신자에게는 학교 기숙사나 외부에 있는 1인용 방을 제공하고, 가족을 동반하는 강사에게는 2개 이상의 침실이 있는 주거를 제공한다. 주거 사용에 따른 제세공과금은 피고용자의 부담으로 한다.

3.고용자는 피고용자의 주거를 선정될 때까지 임시주거를 제공할 수 있으며, 고용기간 동안 주거를 제공하지 못하는 경우에는 피고용자에게 매월 300,000원의 주거비를 지원한다.

4.주거를 제공할 것이지 또는 주거비를 지원할 것인지는 고용자가 선택하며, 일단 선택한 이후에는 고용기간 동안 이를 변경할 수 없다.

5.고용자가 주거를 제공하는 경우 <부록1>에 명시된 가전제품 및 가구를 제공할 수 있으며, 그외의 물품을 요구할 수 없다. 제공된 물품에 대한 관리 및 수리 일체에 대하여는 피고용자가 책임을 진다.

6.최초 계약시 고용자는 생활정착금으로 300,000원을 피고용자에게 제공한다. 피고용자는 상기 항 이외에 생활에 필요한 물품을 구입하는 데 사용하여야 한다.

Article 10(Housing)

1.Employer shall provide Employee with housing. All efforts will be made to provide an apartment within walking distance of the school.

2.Housing selected by Employer may be, including but not limited to, a leased house, dormitory, or an apartment. A single teacher will be provided with a one-room apartment on or off campus, and a married teacher with dependents will be provided with a residence with at least two bedrooms. Any and all fees, charges, costs, taxes, expenses, etc. incurred in using the housing shall be borne by Employee.

3. Employer may provide temporary housing until the appropriate housing for Employee becomes available. If Employer is not able to provide housing for Employee(or if Employee decides to find housing on their own), Employer shall provide Employee with 300,000 Korean won per month, as a rent subsidy, in lieu of the housing set forth in the foregoing 1.

4.Employer shall decide whether to provide Employee with housing or a rent subsidy. Once decided, Employer�s decision shall not be subsequently changed during the Term of Employment.

5.If Employer provides housing to Employee, Employer may provide appliances and furniture (confer appendix 1). Employee shall not request or demand any other appliances or furniture than those provided by Employer. Employee shall take the responsibility for the maintenance and repair for the appliances and furniture provided by Employer.

6.Employer will provide Employee with 300,000 Korean won as settlement money after his/her first contract is signed. Employee must spend the money to buy basics of life other than those set forth under Article 10, item 5.

제11조(기타 혜택)

1.고용자는 피고용자에게 의료보험료(피고용자1인을 원칙으로 하되, 가족 동반시 가족 의료보험료 포함)를 지원한다.

2. 지정된 농어촌, 벽지에 근무하는 피고용자에게는 수당을 매월 100,000원씩 지급한다.

Article 11(Other Benefits)

1.Employer shall provide Employee with medical insurance pursuant to The National Medical Insurance Act of Korea(The National Medical Insurance Act states all government employees will be liable for 50% of costs and premium). If Employee has his/her dependents living with him/her in Korea, Employer will also pay for medical insurance premium for them.

2.Employee who is working in a designated rural area shall be entitled to a paid allowance of 100,000 Korean won every month.

제12조 (유급휴가)

1.고용자는 피고용자에게 고용기간 동안 학기 중이 아닌 기간에 14일의 유급휴가를 제공하며, 15일 전에 소속 기관장에게 휴가를 신청하여 승인을 받아야 한다. 토요일과 일요일은 유급휴가일에 포함시키지않는다. 피고용자가 계약기간을 만료하고 재계약한 경우에, 사용하지 않은 유급휴가는 7일까지 새로운 계약에 이월될 수 있다. 이 기간은 새로운 계약에서 우선적으로 사용되어야 하며 그 이후의 계약기간에는 반영되지 않는다.

2.방학 중에는 고용자가 피고용자에게 추가수당을 지급하지 않고 주당 20시간 보충수업이나 영어캠프활동에 참여하도록 요구할 수 있다.

Article 12 (Paid Leave)

1.Employee shall be entitled to a paid leave for a total of fourteen (14) working days during the term of the employment. Paid leave may be taken at any time school is not in session, and must be approved by principal at least 15 days in advance. Saturday and Sunday do not count as vacation days. If Employee renews the contract, up to 7 days of unused yearly paid leave may be carried over to the new contract period. This carried over paid leave may be used in the new contract period, but it may not be carried over into any subsequent contract period.

2.During school winter and summer break, Employee may be asked to participate in special classes or English camps, up to 20 classroom hours per week (normal salary, no additional stipends).

제13조(병가)

1.피고용자가 근무하기 어려울 정도의 질환이 있을 때 소속기관장의 사전 승인을 받아 유급병가를 받을 수 있다.

2.유급병가기간이 연속7일을 초과할 경우(주말과 휴일 포함)에는 진단서를 소속기관장에게 제출하여야 한다.

3.피고용자의 유급병가 기간은 고용기간 동안 총15일 이내이며, 15일을 초과하는 경우에는 무급으로 한다.

Article 13(Sick Leave)

1.Employee shall be entitled to a paid sick leave if an illness or injury prevents him/her from performing the duties under this contract, provided, however, that he/she obtains Employer�s prior consent.

2.When Employee takes a sick leave for more than seven (7) consecutive days (inclusive of a National Holiday, Saturday and Sunday), Employee shall submit a medical doctor�s report to Employer.

3.Employee�s paid sick leave during the Term of Employment shall not exceed fifteen(15) calendar days. If Employee requires a sick leave for more than fifteen (15) calendar days, Employee may take a longer sick leave without pay.

제14조(특별휴가)

1.피고용자는 다음 각 호의 사유가 있을 경우 특별휴가를 받을 수 있다.

a.피고용자 본인의 결혼 연속7일

b.피고용자의 부모 또는 배우자 사망 연속7일, 자녀 사망 연속5일

c.피고용자 본인의 출산 전후를 합하여 90일

d.자연재해로 인한 휴가

e.기소로 인한 휴가

f.본 조 제1항 제a호, 제b호 및 제d호는 보수가 지급되나, 제c호 및 제e호는 보수가 지급되지 않는다.

Article 14(Special Leave)

1.Employee may take a Special Leave for a number of days as set forth below for each of the following events;

a. Seven(7) consecutive calendar days for Employee�s marriage.

b. Seven (7) consecutive calendar days for the death of Employee�s parents or spouse; five (5) consecutive calendar days for the death of Employee�s child.

c. Ninety (90) calendar days for a female employee�s maternity leave.

d. In case of a damage to Employee�s residence in a natural disaster: the period Director deems necessary according to the degree of damage.

e. If Employee is prosecuted for involvement in a criminal offense, Employer has the authority to put Employee on a prosecution leave.

f. Special Leaves specified in items 1-a,1-b, and 1-d are available with pay. However, the ones specified in item 1-c and 1-e shall be available without pay.

제15조(복무)

1.피고용자는 임무수행에 관련된 소속기관장의 지시를 성실히 이행하여야 한다.

2.소속기관장은 따로 정한 지침에 따라 피고용자의 공적 업무 수행 능력을 평가한다.

3.피고용자는 특별히 정해진 경우를 제외하고 이 계약서의 내용과 조건에 따른 의무를 성실히 이행해야 한다.

4.피고용자는 교사의 품위를 손상시키는 행동을 해서는 안되며, 한국인교사에 적용되는 복무규정을 준수해야한다.

5.소속기관장의 허가 없이는 피고용자는 여하한 조직의 임원이 되거나 다른 기관에 취업할 수 없으며, 급료를 받고 다른 기관에서 영업 행위(시간제 근무 포함)를 할 수 없다.

6.피고용자가 다음과 같은 전염병이나 질환 등이 있을 경우 소속기관장은 피고용자의 업무를 중지시킬 수 있다.

a.전염성 질병이 있는 피고용자가 질병의 확산을 막을 조치를 취하지 않을 우려가 있을 경우.

b.피고용자의 복무중 중증 질환으로 인하여 피고용자가 업무를 지속할 수 없는 경우.

c.피고용자가 보건복지부가 정한 법정 질병에 걸렸을 경우.

d.상기3개항에 관하여는 유급으로 인정한다.

Article 15(Office Regulations and Restrictions)

1.Employee shall faithfully observe his/her principal�s requests on his/her duties defined in Contract.

2.Principal shall evaluate Employee�s performance of official duties.

3.Employee shall devote his/her full working hours and occupational attention to the defined duties in these terms and conditions, except for cases specially provided.

4.Employee shall not damage or tarnish the reputation of the teaching profession. Employee shall comply with and observe any codes of conduct acceptable for Korean teachers.

5.Without principal�s permission, Employee shall not be employed or involved in other paid business (including a part-time job).

6.If Employee has a contagious disease or other illness as set out in the following items, principal may prevent Employee from performing duties.

a.The fear exists that Employee with a contagious disease is not taking measures to prevent the spread of the disease.

b.The fear exists that labor will significantly worsen Employee�s disease from which Employee suffers.

c. Employee is affected by a disease as determined by the Ministry of Health and Welfare.

d. Item a to item c are to be paid for.

1.고용자는 다음과 같은 경우에 본 계약을 해지할 수 있다.

a.피고용자가 대한민국법을 위반하는 경우

2.본 조 제1항 각 호의 사유로 인하여 본 계약이 해지되는 경우 고용자는 피고용자에게 보수를 일할 계산하여 지급하며 귀국 항공료는 피고용자가 부담한다. 그리고 피고용자의 비자는 취소된다.

3.본 조 제1항 각 호의 사유로 인하여 본 계약이 해지되는 경우 피고용자는 제9조 제4항에 따라 대여금을 즉시 상환하여야 한다.

4.피고용자가 금고형이나 그 이상의 중형을 선고받을 경우, 본 계약은 자동적으로 해지되며, 고용자는 금전상 어떠한 보상도 하지 않는다

Article 16(Termination of the Contract)

1.Employer may terminate or cancel this Contract upon occurrence of any one of the following events;

a. If Employee violates the laws of the Republic of Korea.

b. If Employee fails to perform or unsatisfactorily perform any of the duties stipulated in this contract.

c. If Employee fails to perform continuously his/her duties for more than a week without any excuse.

d. If any of the information provided in Employee�s application is neither true nor accurate.

e. If it is determined that the Employee is prevented from or incapable of performing his/her duties set forth in Article hereof for a medical reason, whether it is a physical or psychological ailment.(If requested by Employer, Employee must be immediately available for a medical examination.)

f. If the sick leave used by Employee pursuant to Article 13 hereof exceeds thirty (30) days.

2. In the event that this contract is terminated pursuant to the foregoing 1, Employer shall pay Employee a pro rated salary based on the number of days Employee actually worked. In this case, Employee shall be responsible for his/her return trip to his/her home country. Employee�s visa will subsequently be cancelled.

3. In the event of termination of this Contract pursuant to any of the provision set forth in the foregoing 1, within 6 months of this contract Employee shall immediately refund the loan(airplane fare) to Employer according to Article 9, item 4. After 6 months of continuous employment, the employee is not required to repay this loan.

4. If Employee is sentenced to a term of imprisonment (or any other more severe penalty), Employee shall automatically be dismissed and Employer will not provide any financial compensation.

제18조(손해배상)

1.본 계약의 이행과정에서 피고용자의 주의태만, 과실, 위법행위 또는 이와 관련하여 발생될 수 있는 손해 배상을 피고용자에게 요구하기 위하여 사전에 일정 금액을 고용자는 피고용자로부터 담보한다. 최초급료부터 매월 300,000원씩 3개월 간 총 900,000원을 공제한다.

2.피고용자의 계약이 만료 또는 종료되기 전까지 고용자는 대여한 시설물 이용과 그에 관련된 재정사항 등에 대한 사전점검을 실시하여 발생된 손해가 있을 경우 피고용자에게 서면 확인하고 사전에 공제 담보한 금액으로 배상 조치하고, 부족할 경우에는 추가로 피고용자에게 배상을 요구하여야 한다. 피고용자가 시설물 이용에 대한 주의 성실의 의무를 다하여 손해가 없을 경우에는 사전에 공제 담보한 금액을 계약 만료전까지 반환하여야 한다.

Article 18(Indemnity)

1.Employee shall be responsible for and protect Employer from any liability or damages arising from or in relation to any negligent, faulty, or illegal activity during the Term of Employment under this contract. For safety deposit, 300,000 Korean won per month will be deducted from Employee�s salary for the first 3 months of employment until it amounts to a total of 900,000 Korean won(unless Employee finds their own housing).

2.Employer shall check the leased facilities and financial matters arising from the use of them by Employee before the Term of Employment is completed. If any liability or damages are found, these shall be confirmed in written form by Employee, who will be indemnified from the security deposit pursuant to the foregoing 1. In the case of the insufficient security of indemnity pursuant to the foregoing 1, Employer shall demand further compensation. In the case of protecting Employer from any liability or damages, Employee shall get refunded the whole amount of money secured in advance before the termination of the contract.

제19조 (사전연수)

1.피고용자는 제4조에서 명시된 고용개시일 직전 경기도외국어교육연수원에서 실시하는 사전연수를 이수하여야 한다.

Article 19 (Attending the training program)

1.Employee shall complete a 5 day orientation conducted by Gyeonggi-do Institute for Foreign Language Education immediately before the commencement of the Term of Employment provided under Article 4 hereof.

2. Employee has to attend an orientation workshop sponsored by the Gyeonggi Provincial Office of Education.

제20조 (준거법, 언어 및 관찰)

1.본 계약 및 본 계약상의 권리 의무에 관한 사항은 대한민국법에 의하여 해석되고 결정된다.

This Employment Contract (hereinafter this �contract�) is made by and entered into between Superintendent of the Gyeonggi Provincial Office of Education(GOE), the Republic of Korea (hereinafter �Employer�), and the native English teacher, (Name) Daniel Soedirga (hereinafter �Employee�) a (an) Canadian citizen residing at Japan.

Article 1-1(Purpose) This contract is made for the purpose of setting forth the terms and conditions of employment for teachers who will teach English at a school in Gyeonggi-do schools.

Article 2(Duties) Employee shall perform the following duties.

1.To teach English as an assistant teacher at an elementary school in Gyeonggi-do

2.To do lesson planning and develop teaching materials with a Korean co-teacher.

3.To be involved in extra-curricular classes, teacher training, or English camps requested by the school.

4.To be involved in other activities relevant to English teaching

5.To conduct English Conversational Class(es)/course(s) for Korean teachers, parents, and students

6.To be positively involved in a teacher training program and a English camp designed by superintendent.

So far all camps have been planned by the FT(you)....no one that I know has had any camps designed by the superintendent!

7.To perform other duties as designated by Employer.

Article 3(Supervision) Employee shall perform the duties specified in the foregoing Article 2 supervised by Principal of your host school designated by Employer (Superintendent).

Article 4 (Term of employment) The term of employment shall begin on May 3rd, 2006 and end on May 2 , 2007.

Article 5(Airfare and Resignation)

1.The airfare for Employee�s flight, actual purchasing price, to Korea shall be reimbursed by employer based on an economy class airfare of the most direct flight available from his/her permanent residence to Incheon International Airport.

a.Teacher residing outside of Korea: The Employer shall pay for airfare between the nearest international airport from the Employee's place of residency and a Incheon International Airport in Korea. Airfare will be paid in the following fashion:

A one-way ticket to Korea will be reimbursed after Employee�s arrival in Korea and after the completion of the employment contract a one-way ticket to the airport of departure will be provided

b.Teacher residing in Korea: Teachers hired in country shall have the visa trip to the nearest country from Korea (round-trip airfare) reimbursed by the Employer. After the completion of the employment contract a one-way ticket to the Employee�s foreign residence will be provided.

2.If Employee should decide to resign during the Term of Employment, he/she must give Employer a sixty (60) day prior written notice of resignation stating a date of and a reason for resignation.

30 days should be sufficient.

3.In the case of Employee�s resignation, the airfare for his/her return trip shall be borne by Employee, and his/her visa shall be cancelled.

4.In the event that Employee return home before completing the contract for reasons beyond his/her control, the airfare for his/her return trip may be provided by Employer.

5.In case of the termination of this Contract within six(6) months, Employee shall immediately pay back 100% of the one-way airfare to Employer. If Employee works more than six(6) months during the term of employment, Employee�s obligation to pay back the airfare shall be waived by Employer.

Article 6(Work Place)

1.Employee shall work at a local elementary school and a district office of education designated by Employer.

Article 7(Work Hours)

1.Employee shall work eight ( hours per day (excluding lunch hour) for five (5) calendar days per week from Monday to Friday and shall not work on Saturdays, Sundays and Korean national holidays.

It usually works out to 8 hours a day (including lunch 8:4 or 8:30 to 4:30)

2.The Work Hours of Employee may follow the normal work schedule of civil servants of the Korean Government; however, such Work Hours may be adjusted by principal as he/she deems appropriate.

3. Employee�s regular teaching hours shall not exceed twenty-two (22) hours per week. Employee may be asked to teach some extra classes. Extra teaching should not exceed 6 hours a week without Employee�s consent.

Each class is 40 minutes long and is counted as an hour. You may want to change it to classes

4.Employee shall be paid for the extra working hours. If Employee�s actual weekly class instruction hours exceed twenty two(22)hours, Employee shall be entitled to a supplementary class instruction pay of 20,000Won per hour. Contribution leave may be requested in place of overtime pay. Contribution leave will be calculated as one hour of paid leave for each hour of extra class taught. In case of contribution leave, eight extra classroom hours will be calculated as one day.

Not kosher! 22/5=4.4 classes a day....so if you work 8 extra classroom hours that should be 2 days off not one!

Article 8(Salary)

1.Employee shall be paid 1.800.000 won per month. However, the Korean income tax(*exempted for the first two employment years with the exception of Canadians) and the national pension contribution (*refundable for only Canadian and US citizens) as required under Korean law shall be withheld each month from Employee�s salary.

2.Regarding status of employment: Employee shall be hired pursuant to this Contract as a _

_1st level (Pay: 2.3 million won monthly) English Language Instructor(ELI)/__2nd level(2.0 mill)/_*__3rd level(1.8mill).

3.Employee�s salary shall be paid on the 25st of each month. If this day falls on a National Holiday, Saturday or Sunday, the salary will be paid on the immediately preceding business day.

4.When Employee has not worked a full month, salary for that month shall be paid on a pro rata daily basis either from the first day or until the last day of work.

5.If Employee should be absent from Work without a prior approval, his or her salary for that month shall be deducted by the amount calculated on a pro rata daily basis for the number of unauthorized absent days.

6.Upon completion of a one-year contract, Employer shall pay Employee thirty(30) calendar days, average wage as a severance pay for Employee�s continuous employment of one year.

7.Employee shall not claim against Employer any compensation and/or payment other than those provided for in this Contract.

8.1st level Employee whose contract is renewed for a second term or subsequent terms, may be eligible for an increase in salary. The increase is not automatic and will depend, in all cases, upon the Employee�s teaching performance and contribution toward the achievement of the educational goals of Gyeonggi-do Office of Education. Pay increases for 1st level instructors shall not exceed 100,000 won for every subsequent teaching year.

Article 9(Contract Completion)

1.The Term of Employment stated in Article 4 may be renewed by a mutual written agreement between Employer and Employee, provided that each renewed employment term is one(1) year.

2.In the case of renewal of this contract pursuant to the foregoing 1, Employee shall be given a two-week (weekends and holidays included) home leave which is extra, beyond the 14 days vacation. Home leave should be taken in the summer vacation just before or just after the contract year is up.

3.In the event Employee travels to his/her home country pursuant to the foregoing 2, Employee will be given a free round-trip ticket. The round-trip airfare for Employee�s flight shall be based on the rate provided for in 4 hereafter. In the event employee does not travel to his/her home country pursuant to the foregoing 2, Employee will be given the amount of money equivalent to the round-trip airfare to the different location(expense of this travel fare must be less then the fare of homeland visit) he or she may embark to during their home leave period or if member decides to stay in Korea during this period, the employee will be given the amount of money equivalent to the round-trip airfare to their homeland..

4.The round-trip airfare for Employee�s home leave shall be loaned by Employer based on an economy class air-fare(less than 75% of the regular price) of the most direct flight available from Incheon to the airport nearest to Employee�s residence.

5.If Employee completes the Term of Employment without the intention to renew and leaves Korea within 10 days from the expiration date, Employer shall pay for Employee�s one way return flight.

Article 10(Housing)

1.Employer shall provide Employee with housing. All efforts will be made to provide an apartment within walking distance of the school.

2.Housing selected by Employer may be, including but not limited to, a leased house, dormitory, or an apartment. 4.Employer shall decide whether to provide Employee with housing or a rent subsidy. Once decided, Employer�s decision shall not be subsequently changed during the Term of Employment.

5.If Employer provides housing to Employee, Employer may provide appliances and furniture (confer appendix 1). Employee shall not request or demand any other appliances or furniture than those provided by Employer. Employee shall take the responsibility for the maintenance and repair for the appliances and furniture provided by Employer.

6.Employer will provide Employee with 300,000 Korean won as settlement money after his/her first contract is signed. Employee must spend the money to buy basics of life other than those set forth under Article 10, item 5.

Article 11(Other Benefits)

1.Employer shall provide Employee with medical insurance pursuant to The National Medical Insurance Act of Korea(The National Medical Insurance Act states all government employees will be liable for 50% of costs and premium). If Employee has his/her dependents living with him/her in Korea, Employer will also pay for medical insurance premium for them.

2.Employee who is working in a designated rural area shall be entitled to a paid allowance of 100,000 Korean won every month.

Article 12 (Paid Leave)

1.Employee shall be entitled to a paid leave for a total of fourteen (14) working days during the term of the employment. Paid leave may be taken at any time school is not in session, and must be approved by principal at least 15 days in advance. Saturday and Sunday do not count as vacation days. If Employee renews the contract, up to 7 days of unused yearly paid leave may be carried over to the new contract period. This carried over paid leave may be used in the new contract period, but it may not be carried over into any subsequent contract period.

2.During school winter and summer break, Employee may be asked to participate in special classes or English camps, up to 20 classroom hours per week (normal salary, no additional stipends).

Article 13(Sick Leave)

1.Employee shall be entitled to a paid sick leave if an illness or injury prevents him/her from performing the duties under this contract, provided, however, that he/she obtains Employer�s prior consent.

2.When Employee takes a sick leave for more than seven (7) consecutive days (inclusive of a National Holiday, Saturday and Sunday), Employee shall submit a medical doctor�s report to Employer.

3.Employee�s paid sick leave during the Term of Employment shall not exceed fifteen(15) calendar days. If Employee requires a sick leave for more than fifteen (15) calendar days, Employee may take a longer sick leave without pay.

Article 14(Special Leave)

1.Employee may take a Special Leave for a number of days as set forth below for each of the following events;

a. Seven(7) consecutive calendar days for Employee�s marriage.

b. Seven (7) consecutive calendar days for the death of Employee�s parents or spouse; five (5) consecutive calendar days for the death of Employee�s child.

c. Ninety (90) calendar days for a female employee�s maternity leave.

d. In case of a damage to Employee�s residence in a natural disaster: the period Director deems necessary according to the degree of damage.

e. If Employee is prosecuted for involvement in a criminal offense, Employer has the authority to put Employee on a prosecution leave.

f. Special Leaves specified in items 1-a,1-b, and 1-d are available with pay. However, the ones specified in item 1-c and 1-e shall be available without pay.

Article 15(Office Regulations and Restrictions)

1.Employee shall faithfully observe his/her principal�s requests on his/her duties defined in Contract.

2.Principal shall evaluate Employee�s performance of official duties.

3.Employee shall devote his/her full working hours and occupational attention to the defined duties in these terms and conditions, except for cases specially provided.

4.Employee shall not damage or tarnish the reputation of the teaching profession. Employee shall comply with and observe any codes of conduct acceptable for Korean teachers.

5.Without principal�s permission, Employee shall not be employed or involved in other paid business (including a part-time job).

6.If Employee has a contagious disease or other illness as set out in the following items, principal may prevent Employee from performing duties.

a.The fear exists that Employee with a contagious disease is not taking measures to prevent the spread of the disease.

b.The fear exists that labor will significantly worsen Employee�s disease from which Employee suffers.

c. Employee is affected by a disease as determined by the Ministry of Health and Welfare.

Okay I know it says the start date is in May or whatever but they want me to come in September. I know the payment is alittle lower than usual but I'm willing to accept a small pay cut for certain conveniences (this recruiter is willing to put my girlfriend, my roomate and I all at different schools within 2 train stops of each other since we're all applying together). Its a typical GEPIK contract. If you have 2 years teaching experience push hard for the 2 mil a month ranking.

The type of year you'll have depends alot on your co-teacher and principal. Students are pretty good. If you ask for OT they will probably arrange it.

Grotto, not trying to be picky but you say that Koreans can't live without air-con, which is true.. but you do realise that the Korean Government, and some Koreans, consider it a luxury item, and is taxed as such. That's why air-cons in Korea are so expensive, comparing to other country, say Hong Kong.

I understand that they are expensive....but....Korea is hellishly hot and humid in July and August and that type of climate can be detrimental to ones health and well being. Every Koreans home that I ever visited had air con in their apt/house......GEPIK needs to recognize that many foreigners are not used to their weather and take appropriate steps.

If I had to choose between and ironing board and iron, rice cooker, etc over an air conditioner, i'd take the air con everytime Laughing

I think tzechuk raises a point well worth discussing.

I've never had an aircon here & never suffered for its absence. You, Grotto, on the other hand, argue insistently that every newbie should demand that one be included in the contract.

I'm sorry you dont take heat well, but its not such a big issue with many others. The hot season is brief here. Urging newcomers to demand this expensive appliance might well serve to scuttle otherwise decent deals. If they succeed, they are expensive units to run.

Dont conflate your personal agenda & comfort level with other people's needs.

I would also like to add that in 5 years and 5 successive contracts (6 apartments), I have NEVER had a place that didn't have aircon.

For a private school, it is simply the cost of doing business and in the public system the money IS available... the budget allowance from the province to a public school is more than adequate to provide for it as well as the other things.

I doubt you are going to get many things changed. This is a government contract, if you don't sign someone else will. 1.8 is low but if you have no experience that's standard.

About the only things I don't like are the lack of A/C and the contribution leave...I get TWO hours of contribution leave per hour of overtime classes taught.

I too would never never never sign a contract that did not include air conditioning. I can live without heat before I can live without air. Every contract I have had included it. I ran the air from April till October each year over 80% of the time. I can count on one hand the amount of time I turned on the heat due to being cold. I usually turned it on to help dry my clothes on laundry day when I was not at home. I then had to open the windows to release the heat to be bearable. I do the same in Canada. Bills in the winter months were very low ( under 20,000 won) bills in the warmer months were over 100,000 won and worth every penny. I guess it depends on your own comfort level and how much you beleive your services are worth. We teachers deserve to be comfortable and all contracts should with out a doubt include an air conditioner.

I think an elementary school is a better option than any hagwon. Your contract is about as good as it gets for an average government elementary school. If you have only 25x40 min lessons a week, then you really don't have all that much of a workload by relative standards. The pay is a bit low considering you don't get much vacation period, but as others point out, this is maybe due to your lack of experience in teaching and in Korea. I suggest you just go for this job because one year of this type of teaching really won't kill you (unless the school has some juvenile offenders unit in it!) and you can always move on after that.

Air con is not an absolute essential in the Gyeonggi Do region if you have a place with large windows not facing into the sun. An electric fan should suffice for most mortals! (I'm still sleeping with my jacket and blanket over me!)

1.8 million is too low. Anyone can come to Korea now and get 2.1 or 2.2. You'll be required to work 40 hour weeks at a public school plus extra activities. Why settle for low pay.


Air conditioning: many teachers and many Koreans don't have it. But, it is really hot. Korea has 5 seasons: fall, winter, spring, summer and hell. If you need it, ask for it.


The 60 day / 2 month notice for resignation or termination is perfectly legit and reasonable. It takes at least that long to find a qualified teacher and get them to Korea. If a school or hogwan DOESN'T want a 60 day notice it's a sign that they don't want a professional teacher. 30 days is plenty of time to replace an hourly, worker monkey.


These public school jobs are not as good as a decent hogwan. This is especially true if you really like to teach and have the students learn. In a public school you'll be the foreign entertainment monkey with 40 kids at a time with a variety of levels. You'll see them once or twice a week at best. You can't teach to all of their levels. You will have hundreds, perhaps over 1000 different students. They will learn little or nothing.

Depends on the school. A good public school is much better than a hakwon. A hakwon will nickle and dime you if not outright cheat you. In a public school you don't have to worry about that. And as for teaching find a small public school. My school has about 100 students (about as many as a fair-sized hakwon). I know another teacher who has only THIRTY-SIX students at his public school. A hakwon with that few would go under. But the government can afford to keep it afloat.

In a hakwon you are MUCH more likely to be the foreign entertainment monkey. The kids have seen numberous foreigners before and are well aware that this class is play time as most foreigners can not speak Korean and therefore can not tell their parents. Personally I get FAR more real teaching done at my school than I ever did in hakwons. Then again I do have a fair amount of time to prepare. At hakwons you get about 10 minutes between classes...if that.

Thanks for the help guys. I'm willing to settle for the lower money for the security of it being a public school - I have a few thousand bucks saved up for this anyway as padding. If I like it at all I plan on doing ESL for a few years so paying my dues with the lower salary at first isn't going to bother me much and I live pretty cheaply here in the states anyway.

I can live without aircon since it gets pretty hot as balls where I live anyway and I haven't ever had it in any place I've ever lived. I'd rather just get a huge fan and save on the power bills.

I'll definitely ask them to amend and clarify things though...


Anyway, what's the deal with switching jobs once in Korea? Do they take away your Visa or what?

I think you need to consider altitude and location. The need for air conditioning varies a great deal in any area with mountains.

They will not change the contract one bit. And unless you can read and type Korean fluently, you won't be able to either. The Korean language part of the contract is what will be followed. This is a standard contract and they will not change any of it to suit your special needs. They may give you aircon but that just depends on the school. It will never be written in the contract.
