Ok,

The uni. I just signed with for next year informed me that I do not get severance pay. I was a little surprised about that and I was not interely sure about the legalityof such a clause. So, I decide to do a little research both on dave's and on efl-law about severance pay and although both came close to answering my question they stopped just short of giving me a clear answer.

My questions is; do private universities have to pay severance to their employees in accordance to korean labour law or do they have a certain clause that allows them not to pay?

I remember reading somewhere that if the school has a private pension plan, and is not a part of the national plan, then they have different rules regarding severance and such. This may not be true, but it's the only thing I can think of that would allow them to bilch on it.

Thanks for the quick reponse kprrok,

From the readings I did thats the impression I got as well, but I was wondering if anyone was privy to the law with regards to this and in particular if they can (the university) choose not to pay severance to its employees.
When I spoke to the head of the dept. she told me that all foreign teachers and many of their korean counterparts don't get severance pay at this school.

Its a lie......all businesses MUST give severance....its in the labour laws.\

There was a thread a while back about a guy who worked for a uni for several years and when he left they told him no severance.....he went to the labour board and recieved his severance post haste!

Kpprok dont confuse severance with pension!

Yeah, now that you mention it, I remember that thread too. He mentioned that it wasn't in his contract but the LB still enforced the law.

Definitely, that previous thing I had read (or imagined) was false and not a good guide. I'm gonna look it up in my labor act and find the exact article if I can and post it here later.

Thanks alot willardmusa that was awesome. From what I was told there is a total of about 180,000 won total deductions from my monthly pay and about 90,000 of that is for the pension plan, however, I'm not sure if its the national or a private pension.

I like the job and I have already accepted their offer, when they were explaining the contract to me they told me that they don't give severance and I told them that it was my understanding that it was a legal requirement to pay severance and the guy said that he was not aware of that and that he would check into it and let me know next week.

So, I'm waiting for him to call me back next week and explain to me what's going on. I will keep you guys informed.

Try contacting the Korea Labour Board and the Bar Association in Seoul.
You just might get all the info you need. Cool

Call the Labour Board couselling line on 1350 press 7 to speak to an English speaker. They were v helpful.
