Anal Searches Ruled Constitutional
"Narcotics can clearly be hidden in the anus, and as a minute physical search protects the life and body of the accused and maintains safety and order within the prison, it is not unconstitutional provided the search is conducted in a way that minimizes indignity for the detainee," the court said in its ruling.

Re the (ridiculously brief) article in the OP: was this narcotics suspect detained at Incheon Airport? Was he leaving Korea or entering (relevant, since in some Asian countries, like Thailand, it is the export of drugs that is a capital offence)? How long was he detained for prior to the anal search? Why was he suspected? What was he suspected of? (narcotics = heroin and cocaine, NOT marijuana!) Is it the law and constitutional to search people entering Incheon suspected of drug smuggling? What is the criteria?
Very little can be hidden in the anus - a petty amount sufficient for personal use only. |
