I left Korea 2 weeks ago, and had my bosses (husband and wife) sign a contract stating when they had to pay my fiance and I all the money they owed us. They did fulfil half the contract by paying us all wages on our last day, but they decided to take full advantage of the labour laws and take 14 days to pay us our severance and return our housing deposit. They had until 21st July to pay the last amount of money, and this is what I received in my inbox today...


Hi, *******
How are you? I believe you are spending a great time
with your family.
We tried to send your money today, but we couldn't.
I'm so sorry. I beg you to understand us. So I will
send 1,000,000 Won on July 31,2006, and 1,529,600 Won
on August21,2006. *******, I am so sorry about that.
I will keep my promise.
Once more, I apologize that.
Thank you

If I were you, I'd send a copy of this plus a copy of your agreement to the Labor Board. When July 31 comes around and the money doesn't show up, it would be good to have notified the LB. If the money does come, then you haven't lost out.

E-mail transmissions will be laughed at by the Labor Board. Personally, I think your SOL. If you want to keep trying then send one that's really professional to him. It should include,

Employer name
School name
School location
School telephone number
School business liscence number

Date

Dear (Employer Name),

Body: Indicate when you worked for him and that according to the contract signed by both parties you should have been paid on such and such date.

Sincerly,

Your name

Hopefully he's not dumb enough to reply to this

I can't believe how much that place went downhill in one year. I never had any issues about money there until it came to getting my severance and deposit back. I got my severance back within a month, but it took them 3 months to give me back my deposit, and they were being difficult about that unil we said that we were going to speak with a lawyer. I had my deposit money back the next day. However, I know the school has had a change of everything since then, but you should try it.

In the UK, e-mails can be used in legal proceedings. Isn't it the same in Korea?

There's nothing indicating his boss is guilty of anything whatsoever. He just says he's going to send X amount of Won, and that's he's blah blah blah for it. For all they know, both parties could have made a verbal agreement prior to leaving Korea that doesn't have anything to do with the actual contract. I'm not a lawyer, but this isn't rocket science either Dodgy Al. The OP's in his native county now, and they Labor Board could probably give a crap less about his case!

I can't believe that you would leave Korea without getting paid in full anyway. I've always been paid off the last day or the day before my last day to give me time to take of any banking concenrns, etc. I hope you get what's owed you, but I wouldn't count on it. You are far more trusting than I.

She isn't laughing at getting an e-mail, she is laughing because they made a verbal agreement and then as soon as she left, she gets an e-mail saying they aren't going to pay her on time.

Not only did I get a verbal agreement, I wrote up a contract for myself and my fiance and had the husband and wife sign it. I visited the labor board twice during my last week in Korea, and they were the ones that suggested I get it all down in writing as this can help your case when you file it. Unfortunately by law you aren't required to get your severance on your last day; employers have 14 days to pay you. So no, own_king, I'm not more trusting than you, I envisioned the worst case scenario early enough to get the scumbags to sign a contract. And yes, Corporal, maybe we will get our money eventually, we have 3 years to make a claim at the labour board, pity you have to be in Korea for 30 days to make it happen.

Now... where's the Korean Hogwan Blacklist... Twisted Evil
