I've just started the 5th month of my contract in Korea and I want to fix my situation before the 6th month so that I can find another job if needed be. My boss tells me that he takes money out of my pay for private health care but I have no card, no proof or assurance that I will be helped in an emergency. I figured out that this isn't normal so I asked my boss about the procedure. He said if I go to a doctor I pay cash and then I will be paid back by the company. I asked him - what happens if I break a leg or need an operation? how can I pay for that? He walked away with a confused look on his face.
I'm canadian so pension payments are beneficial to me. I didn't know they existed until now. I have not paid into them for 5 months. Must my boss pay them by law? If so, can I get back payments for the last 5 months? My working visa card has a misspelling on my name too. The first name spelt CHRISDPHER and not CHRISTOPHER.
efl-law.com and efl-law.org have only helped me a little bit as one has many broken links and the other lacks content. I may get a lawyer for this situation... I may leave in the night. I would like to give my boss a list of changes I need made and then leave after he stalls for a few weeks. Please advise me as soon as possible because I want to fix this right away. Thanks so much |

If you are paying health care then you should have a health care card which you show the doctor each time tou visit. No card, no health care. He must by law pay into the pension scheme, 50% you, 50% him. You can recover the total pension contributions when you leave Korea. I would also get the spelling mistake corrected on your ARC, that will only take 10 minutes at your local immigration office. He is ripping you off, you need to speak with him about these problems. Please allow me to be as polite as possible - Your boss is a liar and a thief.
National Health (NHIC) care is required BY LAW as of Jan 2006.

You will have to back pay from the time you entered Korea.
Pension is also required by law. When you are enrolled, you and your boss will both have to kick in the required back payments.
The spelling error on your ARC is not unusual. Next time you get near the immigration office take your ARC and PASSPORT back to the counter and they will fix it and give you a new-corrected card. There is NO cost and it takes about 15 minutes to print a new one. |

a lawyer is useless....it would cost you more than you could afford!
Leaving in the night ....thats one way of dealing with it I suppose....or you could contact the labour board and let them deal with him.
I need made....I have no clue what that means!
After he stalls for a few weeks....thats an assumption...give him the benefit of a doubt...after all you were stupid enough to go along with this for 5 months whats another 7 more?
Next time do a little research before you jump in! |

Thanks for all the help. Your advice has and will help me a lot. I'll be giving my boss my list of demands and I'll hopfully have the matter resolved. I'll be getting a lawyer this week as a threat but I doubt that it'll need to be done. I really appreciate those who come on this website and post valuable comments, taking up much of their time. |
