So I have an interesting pension issue with my hagwan. I'd been working at my Hagwan since last December, but when I went to claim my pension, my school had only listed me as working there since June. Basically, I'm getting screwed out of 6 months of Pension. I went to Hagwan first, thinking it was a mistake and they would want to take care of it without going through immigration and the board of labor. Instead, my hagwan told me that they hadn't specifically included that in my contract, and therfore I shouldn't expect any pension. While the pension wasn't listed in the contract I assumed it wasn't necessary, because it was the law. In the US every contract you sign doesn't specifically say that you will pay into social security, it just happens. They agreed that it was the law, but they didn't think it was a fair law so they didn't obey it. I also asked them why they chose to start paying into the pension in June. The Hagwan told me that Immigration contacted them and told them they had to register me. Like I said I started working in the middle of December, and until May the Hagwan never took any money out of my pay to contribute to the Pension fund. It also wasn't until May that I started asking questions about my Pension. Since I found out about my short Pension (last Friday) another teacher went to the office to check on his, and found out his never existed. I'm looking for anyone who can point me in a direction to find someone that I can contact to clear this issue up. The money in question is almost 800,000 won, so I am very serious about recovering it. My hagwan seems to just be trying to drag things out and stall me. I gave them a chance to fix the issue, and they chose not to, so now I'm ready to handle it through immigration or the board of labor.

You can contact the pension office in your area and explain the situation to them. You may need to provide evidence(your contract) and that should initiate an investigation. Of course, you should confirm with them which direction they will take.
I had a similar issue with pension several years ago and once the school was contacted by the pension office, the money mysteriously appeared in the pension account.

I have brought something up at the office, but there wasn't a lot of motivation to do anything there. I showed him my immigration card (issued in December 2005) and my visa (issued in December 2005). He told me he could only give me the money that the computer showed I was owed. That last link has some links for people up the food chain though, so hopefully that will yield better results. Thanks for that info. |
