NK: No we arent
US: Yes, and heres proof
NK: Ok, we are.

It went like this.

US: We think NK might be breaking the agreement, because that would be just like them.

NK: Don't worry we have no plans to go nuclear.

US: Darn. We can't find any proof. Our sattelite images show the factory is closed and we haven't been able to detect any activity.

NK: Ok, the time is right to increase our leverage at the talks. "We have nukes".

US: Damn! How did you do that?

As my link proves.. The US has very little ability to know whats going on in NK.

Really you are a moron. When the whole thing broke in 2001 it broke because the US confronted NK with proof of them breaking the agreement. The Norks didnt admit to having a bomb until much later, if I recall after kicking out the inspectors and leaving the NPT.

Pay attention to the news idiot.

There was no proof, dic k head.

There were allegations. But there was no incontrovertible evidence.
The US has consistently been unable to know what has gone on in NK with any certainty. If their surveillance was that hot, they might have known by now if the test was indeed nuclear, or maybe they would have been able to stop guys with boxcutters flying planes into them? The US actually helped them with their nuclear programme. How dumb was that?

American photography of Korea is probably even worse than yours.
