EMPLOYMENT AGREEMENT FOR TEACHER
FIRST YEAR CONTRACT

This EMPLOYMENT AGREEMENT has been made this from 00,00, 2006 to 00,00, 2007 between being represented by established under the laws of south Korea at Republic of Korea and write your full name as same as your passport a citizen of

Both parties agree on the following terms and conditions :

CLAUSE 1 (APPOINTMENT)
a. The employer agrees to employ the teacher during the period stipulated herein
b. The teacher agrees to accept the employment and will work in his/her full
capacity for the school

CLAUSE 2 ( EQUAL IDENTITIES & WORKLOAD )
a. The employer and employee are individuals of equal value and respectability
coming together respectfully to exchange their services.
b. The service of the employee is to offer certain agreed-upon 120 teaching hours a
month ( on the basis of 60 minutes an hour) in the humane way he/she agreed
upon here or hereafter. The employer will return the employee's energy and
efforts material and service support such as proper housing , salary , as mutually

CLAUSE 3 ( PERIOD OF EMPLOYMENT)
a. The total agreement term is approximately one year , commencing from the date of arrival in korea and to the last teaching day of the teacher's twelfth teaching session.
b. The term of this agreement includes an orientation period , twelve consecutive
teaching sessions , and all scheduled vacations and holidays that fall between
or during teaching sessions.
c. The teacher agrees to discontinue his/her residence in Korea under the visa
status arranged and sponsored by the employer and leave from the status within five days of termination of this contract.

CLAUSE 4 ( THE TEACHER DUTIES)
a. During the term of this agreement , the teacher must cooperate and comply with the instructions and disciplines of the school . Assisting the supervisor he/she must carry out assignment as directed by the employer.
The supervisor will be responsible for establishing and communicating the standards of performance as related to the above mentioned duties.
b. The teacher must have adequately prepared for the class in advance
b. The term of this agreement includes an orientation period , twelve consecutive
teaching sessions , and all scheduled vacations and holidays that fall between
or during teaching sessions.

d. In case the teacher is absent from the class , and thus unable to teach the class , even with a sudden notice , the employer will determine the situ and consider it as a sick day or a non-sick day.
e. The teachers work will include the followings :
a) Teaching of English language
b) Development of educational programs and materials
c) Curriculum design and implementation
d) Indoors and outdoors classroom activities for/with students
e) Grading and assessment of students
f) Student counselling or evaluation
g) Attending at teachers meetings , workshops , parents meetings and school events
h) Other related activities

CLAUSE 5 ( SALARY AND WAGE )
a. The employer agrees to pay the teacher a monthly salary of 2.1 million won for 120 teaching hours per month.
b. The payment of the salary is to be made in ______ of the following month
c. Each teaching hour exceeding the 120 working hours is considered as overtime. And the payment for the overtime will be 20,000 won per each working hour.
d. Attendance at scheduled staff meetings and workshops should be mandatory and are not accounted for the overtime.

CLAUSE 6 ( WORKING HOURS )
a. During the terms of this agreement , the teacher should work in proper manner and under good cooperation with the supervisor from Monday to Friday.
b. The teacher can be requested by the supervisor to participate in the scheduled staff meeting and workshop.
c. The employer can not guarantee the teacher for such classes of specific times as requested by the teacher.

CLAUSE 7 ( TAX )
Income tax and retirement taxes will be deducted off the salary according to the Korean tax law(3-5%).

CLAUSE 8 ( TRANSPORTATION )
a. The employer is to provide the teacher with an economy class ticket and from the nearest international airport to the teachers residence in Korea.
b. After completion of the one-year contract , the teacher will be provided with a return ticket . The return air ticket will be provided at the time of termination of employment.
In the event that the teacher continues employment under a subsequent employment agreement with employer; the return air ticket will be provided at the time of completion of the subsequent contract period(s).
c. Air tickets provided cannot be exchanged for cash equivalents or transferred to persons other than the teacher. Employer does not agree to, and is not liable for, compensation to teacher, whether in cash or otherwise, for air tickets which are not used by teacher.
d. In case the teacher leaves the school before his/her contract period ends, the school will not pay for his/her return ticket.
e. If the teacher leaves the school before six (6) months period of this contract for his/her own sake, the teacher must reimburse the school the cost of the ticket the school has paid for his /her trip to Korea or the school may deduct the same off the teachers last month payment.

CLAUSE 9 ( MEDICAL INSURANCE )
a. The teacher will be covered by medical insurance under the Korean Medical Insurance Union , a private health organization.
b. The half of the insurance premium will be paid by the Employer and the other half by the teacher.
( For reference , the current insurance premium rate is 1.5 % of a monthly income)

CLAUSE 10 ( VACATION & HOLIDAYS )
The teacher will be allowed for 10days holidays as specified by the Institute with all of national holidays.

CLAUSE 11 ( ACCOMMODATIONS )
a.The school will provide the teacher with furnished accommodations
a. The school will provide the teacher with furnished single accommodation.
b. Furnishings being provided by the employer include : television , refrigerator , washing machine bed , kitchen table , chairs , two-burner gas hot plate , and telephone , etc..
c. Selection of the apartment will be determined by the employer.
d. The cost of monthly service , utilities , and telephone charges for the accommodations will be paid by the teacher .

CLAUSE 12 ( ANNUAL BONUS )
Upon completion of this one year contract , the teacher will receive one month salary of 2.1 million won as a severance payment in accordance with Korean Labor Laws. This Payment will be made at the time of completion of the contract period.

CLAUSE 13 ( DISMISSAL OR VOLUNTARY RESIGNATION )
a. The employer reserves the right to dismiss the teacher from employment for the following causes :
a) Neglect his/her duties stipulated in this agreement.
b) Frequent absences from work.
c) Has received two warning letters.
d) The inability to perform the duties stipulated in this agreement
e) The teachers criminal or misconduct

b. The employer agrees to dismiss the teacher from employment giving 30 days notice . However in case of the teachers criminal or misconduct he/she is to be dismissed from employment
c. In such case as the teacher resigns from employment, he/she can do so giving 30 days notice to the employer.
d. In either case of dismissal or resignation before completing six (6) months period of this contract term , the teacher must reimburse the employer the ticket cost paid for his/her trip to Korea .The employer hereby agrees to grant the teacher a letter of release if the contract is not breached.
e. The teacher is not allowed to teach a private class outside the school unless otherwise agreed by both parties. If the teacher teaches a private class outside the school without the employers permission , it would result in dismissal of the teacher , in which case the school has no obligation to pay the teacher a severance payment and the cost of his/her return ticket.

CLAUSE 15 ( GOVERNING LAW & JURISDICTION )
a. This agreement is governed by the law of the republic of Korea.
b. This agreement is made final and firm unless any material modification or amendment to this agreement is executed with the full knowledge and consent of the undersigned and incorporated into this agreement.

This Labor Contract has been entered on (date) between (name of school), located at (location), established under the laws of South Korea hereinafter referred to as the employer, and ( full name), a (Country) citizen hereinafter referred to as the teacher, located at ______.


CLAUSE 1 (APPOINTMENT)

a. The employer agrees to employ the teacher during the period stipulated herein

b. The teacher agrees to accept the employment and will work in his/her full capacity for the school

CLAUSE 2 ( EQUAL IDENTITIES & WORKLOAD )

a. The employer and employee are individuals of equal value and respectability coming together respectfully to exchange their services.

The employer will not discriminate against workers by sex, or take discriminatory treatment in relation to the conditions of employment according to nationality, religion or social status.

b. The employee will work 100 classes that are 60 minutes in length per work month throughout the contract period. .

CLAUSE 3 ( PERIOD OF EMPLOYMENT)

a. The term of this labor contract is one year in accordance with Korean Labor Laws.

b. The term of this agreement includes an orientation period, scheduled vacations, and Korean National Holidays.

c. The teacher agrees to discontinue his/her residence in Korea under the visa status arranged and sponsored by the employer and leave from the status within five days of termination of this contract.

d. The teacher will work as well as participate in work related activities (Workshops, Training, Orientation, Classroom observation, Meetings, etc...) for the employer when Korean Immigration Officials have issued the teacher an E2 Visa.

CLAUSE 4 ( THE TEACHER DUTIES)

a. During the term of this agreement , the teacher must cooperate and comply with the instructions and disciplines of the school . Assisting the supervisor, he/she must carry out duties stated in the labor contract.

b. The teacher must have report one hour early before his/her first class to preparation purposes.

c. The teacher is entitled to 4 paid sick days throughout the contract period. A note from a Medical Doctor must be provided to the employer after the teacher has been sick for two days.

d. The teacher is entitled to 5 days of emergency leave throughout the contract period. This may be taken when there's a death in the family, and the employer may require proof. Emergency leave shall be unpaid.

e. The teachers work will include the followings :

a) Teaching of English language
b) Written evaluations due by 5th of following month, and submitten to employer.
c) Attendance at teachers meetings
d) workshops: 1 per month
e) parents meetings: 1 per month


CLAUSE 5 ( SALARY AND WAGE )

a. The employer agrees to pay the teacher a guaranteed monthly salary of 2.1 million won for 100 classes worked month. Payment of wages shall be directly made in full to worker throughout the contract period. If the employer is unable to provide 100 classes to be worked, then the teacher will shall be paid his/her guaranteed monthl salary.

b. The payment of the salary will be made on the 5th of the following month. Furthermore, the teacher shall recieve his last working months salary on the last working day of the contract period.

c. Each class exceeding the 100 classes is considered as overtime. And the payment for the overtime will be 21,000 Korean Won each overtime class. Overtime classes shall be 60 minutes in length, and consist of teaching English to Korean Students.

d. The teacher shall be paid overtime in the amount of 21,000 Korean Won for weekend classes worked throughout the contract period.

e. Both parties shall agree in writing before overtime classes are worked. They teacher may refuse to work overtime classes without punitive actions taken by his/her employer.

CLAUSE 6 ( WORKING HOURS )
a. The teacher should work in proper manner and under good cooperation with the supervisor from Monday to Friday. Furthermore, the teacher will work 5 (60) minute classes, 60 minutes of preparation for pay, and use a 30 minute "recess period" freely on a daily basis throughout the contract period. The teacher shall work from _____ until _____ unless agreed otherwise.

b. The teacher can be requested by the supervisor to participate in the scheduled staff meeting and 1 workshop per month.

CLAUSE 7 ( TAX & Koreann National Pension Plan)

Income tax will be deducted off the salary according to the Korean tax law. The employer will deduct 33,430 Korean Won from the teacher's monthly salary throughout the contract period, and pay deductions to the District Tax Office concerned.

In accordance with the Korean Law, all foreign workers employed by Korean businesses shall pay into the Korean National Pension Plan at a rate stipulated by the Korean National Pension Law deducted from monthly earnings by the employer with the Institute's contribution. The employer will deduct 4.5% in the amount of 94,500 Korean Won from the teacher's monthly earnings, and the employer will contribute 94,500 Korean Won. Refund of the National Pension to a teacher who becomes a compulsorily insured Teacher, where the Pension Act of the Teacher's home country provides the benefit corresponding to the lump-sum refund of the National Pension Plan, the lump-sum refund of this plan shall be paid to the foreigner, according to Korean Law

CLAUSE 8 ( TRANSPORTATION )

a. The employer is to provide the teacher with an economy class ticket from the nearest international airport to the teachers residence in Korea.

b. After completion of the one-year contract , the teacher will be provided with a return ticket . The return air ticket will be provided at the time of termination of employment.

In the event that the teacher continues employment under a subsequent employment agreement with employer; the return air ticket will be provided at the time of completion of the subsequent contract period(s).

c. Air tickets provided cannot be exchanged for cash equivalents or transferred to persons other than the teacher. Employer does not agree to, and is not liable for, compensation to teacher, whether in cash or otherwise, for air tickets which are not used by teacher.

The employer agrees to pay for lodging, travel costs, reserve hotels, and issue 50,000 Korean Won prior to for E2 Visa processing fees while the teacher obtains his/her E2 Visa in Fukoka Japan.

d. In case the teacher leaves the school before his/her contract period ends, the school will not pay for his/her return ticket.

e. If the teacher leaves voluntarily resigns before completing (6) months of employment, the teacher must reimburse the school the cost of the ticket the school has paid for his /her trip to Korea or the school may deduct the same off the teachers last month payment. Airfare reimbursements shall be waived after the teacher has completed (6) months of employment.

CLAUSE 9 ( MEDICAL INSURANCE )

The employer will deduct 2.24% from the employee's monthly salary in the amount of47,040 Korean Won throughout contract period.

The sum of 3 month contributions in the amount of 141,120 Korean Won shall be prepaid every month by the employer to be paid to the National Health Insurance Corporation.

Furthermore, the employer will enroll the employee in the Korean National Healthcare Plan within 5 working days upon issuance of the employee's E2 Visa from Korean Immigration Officials.

CLAUSE 10 ( VACATION & HOLIDAYS )

The teacher will be entitled to 10 days of paid leave (5 consecutive days in the summer & 5 consecutive days in the winter), and Korean National Holidays.

The employer shall not dismiss, lay off, suspend, transfer the teacher, or reduce wages, or take other punitive measures against teacher without justifiable reason(s). In accordance with Korean Labor Laws, justifiable reason(s) shall herein be referred to as serious violations within the workplace, violation of Korean Laws, and gross negligence.

a) Serious violations within the workplace: Working under the influence of illegal drugs, working under the influence of alcohol, and smoking in the classrooms.

b) Gross negligence: The teacher may be dismissed for gross negligence which shall be defined herein as, "Failure to use even the slightest amount of care in a way that shows recklessness or willful disregard for the safety of others."

c) Violation of Korean Lawss

b. The employer agrees to dismiss the teacher from employment giving a 30 days written notice. The teacher may be dismissed immediately if found guilty of violating Korean Laws.

c. In such case as the teacher resigns from employment, he/she can do so giving 30 days written notice to the employer. The teacher may terminate the labor contract pursuant to Article 26 of the Labor Standards Act:

Article 26 (Violation of Conditions of Employment)

(1) If any of the conditions of employment set forth in accordance with Article 24 is found to be inconsistent with the actual conditions, the worker concerned shall be entitled to claim damages resulting from the breach of the conditions of employment or may terminate the labor contract forthwith.

(2) If a worker intends to claim indemnity for damages in accordance with paragraph (1), he may do so with the Labor Relations Commission. If a labor contract has been terminated, an employer shall pay travel expenses to a worker who changes his residence for the purpose of securing new job.

d. In either case of dismissal or resignation before completing six (6) months period of this contract term , the teacher must reimburse the employer the ticket cost paid for his/her trip to Korea. Airfare reimbursements shall be waived after the teacher has completed 6 full months of employment.The employer hereby agrees to grant the teacher a letter of release upon request.


e. The teacher is not allowed work outside the place of employment without written consent from the employer, and authorization from Korean Immigration Officials.

CLAUSE 15 ( GOVERNING LAW & JURISDICTION )

Both parties shall comply with rules of employment, and terms of the labor contract, and each of them shall be obliged to do so in good faith. The employer shall comply with Articles 1-13 (Chapter I), Articles 22-24, 26-41 (Chapter II: Labor Contract), Articles 42 - 48 (Chapter III: Wages), Articles 49 - 61 (Chapter IV: Working hours & Recess), Articles 63, 68,69,71-73 (CHAPTER V: Females and Minors), Article 76 (Saftey and Health), Articles 81 - 95 (Chapter VIII: Accident Compensation), Articles 96 - 100 (Chapter IX: Rules of Employment), and Articles 110 - 116 of the Labor Standards Act.

crap clause #1...you want to know how many classes a week you will be teaching! how many students per class, how long each class is! this crap is much too vague! Also they are counting only in class time towards your pay.....so you are going to be in class for 7200 minutes....add in break time etc and you will be putting in 8 hour days +!You want a set schedule not this bullcrap!

this makes no sense! you get all national holidays and shoudl recieve a minimum of 10 days in addition!

CLAUSE 11 ( ACCOMMODATIONS )
a.The school will provide the teacher with furnished accommodations
a. The school will provide the teacher with furnished single accommodation.
b. Furnishings being provided by the employer include : television , refrigerator , washing machine bed , kitchen table , chairs , two-burner gas hot plate , and telephone , etc..

get an exact etc....air con is a necessity!

c. Selection of the apartment will be determined by the employer.

it will be clean and within 5 minutes walk of the institute!

d. The cost of monthly service , utilities , and telephone charges for the accommodations will be paid by the teacher .

CLAUSE 12 ( ANNUAL BONUS )
Upon completion of this one year contract , the teacher will receive one month salary of 2.1 million won as a severance payment in accordance with Korean Labor Laws. This Payment will be made at the time of completion of the contract period.

CLAUSE 13 ( DISMISSAL OR VOLUNTARY RESIGNATION )
a. The employer reserves the right to dismiss the teacher from employment for the following causes :
a) Neglect his/her duties stipulated in this agreement.
b) Frequent absences from work.
c) Has received two warning letters.
d) The inability to perform the duties stipulated in this agreement
e) The teachers criminal or misconduct

b. The employer agrees to dismiss the teacher from employment giving 30 days notice . However in case of the teachers criminal or misconduct he/she is to be dismissed from employment

criminal ok....misconduct....give notice!

c. In such case as the teacher resigns from employment, he/she can do so giving 30 days notice to the employer.

LEGALLY YOU CAN BOLT ANYTIME YOU WISH!

d. In either case of dismissal or resignation before completing six (6) months period of this contract term , the teacher must reimburse the employer the ticket cost paid for his/her trip to Korea .The employer hereby agrees to grant the teacher a letter of release if the contract is not breached.
e. The teacher is not allowed to teach a private class outside the school unless otherwise agreed by both parties. If the teacher teaches a private class outside the school without the employers permission , it would result in dismissal of the teacher , in which case the school has no obligation to pay the teacher a severance payment and the cost of his/her return ticket.

CLAUSE 15 ( GOVERNING LAW & JURISDICTION )
a. This agreement is governed by the law of the republic of Korea.
b. This agreement is made final and firm unless any material modification or amendment to this agreement is executed with the full knowledge and consent of the undersigned and incorporated into this agreement.
