I am currently on an E-2 visa. I am planning to re-sign with my company. My current contract (and visa) expire Feb. 27.
I am leaving the country to visit family from Feb. 20-March 10. When can I go and renew my visa?
Will they do it early February for a contract that doesn't start until March 1?
I am concerned that if I ask my company to start my new contract earlier (e.g. Feb. 15), then I could potentially be denied benefits like severance for not "finishing" my original contract (even though I'll be staying at the same place).
I'm sure someone out there has been out of the country when your visa was set to be renewed. Can you advise? I'm asking now because I need to sign my new contract and am concerned if I should ask for a different date of start. |

For a contract / visa extension you can go in to the immigration iffice up to a month before the current contract/visa expire.
In your case you can go in anytime after Feb 1 to do your renewal/extension.
In regards to your "severance" it is NOT a contractual issue but a labor law and they are required to pay you 1 months pay as severance for each and every full year of employment. It has nothing to do with "finishing" your contract but completing each full year. |

Don't forget to get any multiple entry visas renewed if you are leaving the country.
