depends on how you say it.
it can be "no he can't be smart" - agreement
or also "no, he is smart" - contradiction
for avoiding misunderstandings say the whole sentence.

Or should you say, "Yes?" That seems to be the best answer. Yes, he can't be smart. |

That can be confusing, though. Many people would then ask, "Do you mean yes he is smart, or yes I'm right that he is stupid?" |
