At first the wrongs most commonly litigated in the royal courts were wrongs to land , promptly it was observed that they could be committed either by disseisin , applying force directly (as by invading the land and driving the owner out ), or by nuisance , indirectly and without touching the land (as by diverting a watercourse or blocking a way leading to it ). Such was the situation by the end of 12th century.
Would please tell me the difference between disseisin and nuisance ?
If my neighbors trees in the garden make my room can not receive enough sun shining , is it nuisance ? |

I wasn't sure of some of the language but if I understand the paragraph correctly then yes, it would be nuisance.
Good luck,

As for your first question, disseisin is the intentional denial of property rights, while nuisance is unintentiomal... What a strange word. I was sure it was a typo until I found it in an online dictionary. I shouldn't have doubted you, Jenny. |
