I am wondering if anyone has been able to verify this. I have heard rumors(on these forums) that the rules are changing in 2008 and the standard vacation will be bumped up to 15 from 10.

Is this true? or is it just wishful thinking and gossip?

Thanks. Where can I find that in writing? Can you point me in the right direction? We are negotiating for January and I would like to show them in writing. So far everyone is just keeping with the standard 10 in all their offers.

Article 59 (Annual Paid Leave)

(1) An employer shall grant 10 days� leaves with pay to workers who have offered work without an absence throughout a year and 8 days� leaves with pay to those who have registered more than 90 percent of attendance during one year.

(1) An employer shall grant 15 days� paid leave to worker who has registered more than 80 percent of attendance during one year. <Amended by Act No. 6974, Sep. 15, 2003>

It looks like if an employer has been present for 80% of the time at with an employer, you get 15 days paid leave at the end of your employment contract.

So try to negotiate saying that you will take 3 weeks worth of leave if you haven't been absent for less than 80% of the time. Nice to have 3 weeks leave at the last month.

So these 15 days of leave is in addition to the normal 10 days that most hagwon employees receive? How does this affect those in public schools through next year?

1. 1,000 workers or more: July 1, 2004;
2. Businesses or workplaces with 300 workers or more but less than 1,000 : July 1, 2005;
3. Businesses or workplaces with 100 workers or more but less than 300 : July 1, 2006;
4. Businesses or workplaces with 50 workers or more but less than 100 : July 1, 2007;
5. Businesses or workplaces with 20 workers or more but less than 50 : July 1, 2008; and
6. Businesses or workplaces with less than 20 workers : a date determined in the Presidential Decree but no later than the year 2011.

Paid Leave does not include weekends and National Holidays.
So Its best to plan it during Chinese New Year.

I assume from these posts that I would not be able to try and get more then the standard 10 days.I couldn't say that I am legally to receive 15 days.
