I had my E-2 visa approved, but due to the schools actions I no longer want to accept the job.
What are my options for taking another position? How long do I have to wait before I can take another job? If I decline to take this position, can I transfer the visa in 3 months, or do I need the permission from the original school? Can I neglect to get the visa at the consulate and just enter on a tourist visa now?

If you check some of his previous posts you will get the whole tale.

I have been looking, but can not find the info (yet), but one they have issued a number you can not cancel it. You might have to end up waiting a few months. But do not quote me on that ttompatz will have better info.

Looks like you have to wait 90 days for the visa to expire and that also means getting new documents.

What are my options for taking another position? You can but you'd have to get all of your documents again.

If I decline to take this position, can I transfer the visa in 3 months, or do I need the permission from the original school? You can't transfer your visa unless you school gives you permission, and I believe there is a minimum time period as well.
Can I neglect to get the visa at the consulate and just enter on a tourist visa now? Yes, but only as a tourist and without your documents you wouldn't be able to get a work visa, so why?

The 2nd school is telling me to ask the 1st school to fire me and then report it to immigration, and then I will be able to work at the 2nd school.
Does anyone know if this is true?
Do I have to work at the 1st school for a certain amount of time to be able to do this? Or does it not matter?

I don't think it has to be that extreme. I did something similar. I was finishing at school 1, got a visa change to multiple entry and signed a new contract with school 2 (I only had single entry at the first school), and before the 2nd school contract period started, school 2 and I decided not to work together (mutually). I went to immigration with school 3 and immigration just processed it as if I went from school 1 to 3. They added a change of work location stamp in my passport and updated my ARC card.

In your case, you probably won't need the ARC card update if you are new to Korea. Also, I needed another transfer letter, which you probably don't need.

The question is, who should go with you to immigration? School 1 or School 2? I am thinking school 1, but you need to have all the paperwork with school 2 also when you go so immigration can see you could have a different employer. They are less likely to ok it if you just walk in and ask them to cancel the first school's contract.

Another option in case nothing else works is to change your visa to a D10. This would be something to buy yourself more time, but if you already have a second school then hopefully the officer you talk with will see the extra paperwork it will take and just allow a simple location transfer and update the contract with the new one. Your ARC card could also be applied for.

Are you in Korea or trying to do all this out of Korea? That might also have a bearing on all this. If you are in Korea, you might have a greater chance of getting all this changed over. If you want to play it safe, get new documents, and I think you have to wait 90 days for the current visa to expire.

I'm outside of Korea, so I don't yet have an ARC card. I think because I have not yet started this job and am not currently in the country.. I may be in a more difficult situation.

If you have a visa in your passport you will need to wait till it expires.
Depending on the consulate that may be 90 days hence or 1 year hence (I assumed you were American). IF you are not American then 90 days after date of issue.

If you have NOT you got your visa in your passport then your confirmation number will expire in 90 days and you are free to start again. You can do nothing in the meantime except arrange for new documents.
