|
|
Im trying to get all the information I could about the D10 visa as possible and its going well but I was curious about one thing. I know some employers will refuse to give you a LOR for whatever reason. With that in mind, is it possible to get a D10 without a LOR and whats the way to get around it if your employer is being difficult with you leaving? |

How far into a contract are you? Are your trying to quit early? Timing is part of the process.
Only two other ways to get a D-10 without a LOR...
1) Employer has given proper notice of termination.
2) Notification from the Labour board. Previous school has to have committed some labor violation.

I also have a D10 question so I thought I'd add it to the thread if that's ok ...to help add to the D10 info.
Can you switch from a tourist visa to a D10 while in Korea? (and then onward to the E2)
Hopefully making the Japan visa run obsolete to those who are so blessed with cracking the Times top 200 Unis. |

No! No tourist visa or visa waiver can change to another visa IN COUNTRY.
You will need to do a visa trip. Be happy Japan is close by.
(Note: Usually there is no change allowed with tourist visa's. I think for some F-6 it can be done. Overall immigrations regulations say no.) |

Not as big of a deal. Don't worry about the dramatized replies. |

Through the question is can a person apply for a D-10 in home country? In that case I think the applicant has to be from one of the 200 top universities.

So does timing really make a difference? What if you extended and are into your second year with a school, have problems and the school refuses to give you a LoR? Does the fact that you previously completed a year work in your favor? |

I think the D10 rule they police is that you can only switch to a D10 a certain number of times in a year. It might even be just once.
They will NOT police or judge you better or worse if you completed a year or not. The question of how long you have worked pertains to earlier periods where you might not have an ARC or you are under 6 months and may have other legal obligations (return airfare, whatever you agreed to). Again, this isn't really an immigration issue, but an officer might still consider this against you.
Practically speaking, if you have completed 6 months, given notice, found another school, and gone to immigration, you "should" be able to just transfer.
If immigration wants to "transfer" your E2 to D10, back to E2, then joy is on them.
Do you want to put yourself in an unemployed state begging immigration for a D-10? You won't have a place to stay for free and you won't be earning an income. Your choice. |

Success! In an answer to my own question above... Yes, you can. Maybe*
I have switched from a tourist visa to a D10
Ahh, the ever evolving rules of Korean immigration...bless 'em
I forgot to mention above that I previously held an E2 visa that expired a year ago. Not sure if this is what allowed me to do it or not.
Went to Kimmi an Anguk station
-Provided copied/stamped/notarized degree and CRC. Which they didn't keep but had me make copies of for them.
-Passport / photo
-Visa application that the agent provided
- Filled out a 'Job search plan'
- 50,000 for visa stamps + 10,000 for the visa card
*Those familiar with Kimmi will know that though it worked yesterday it might not work tomorrow. |

Me I am fine. Just keeping up to date.
I was pretty certain that transferring to other visas on a Tourist visa was difficult or impossible.
I have heard from tourist to F-series was possible. But that might have changed according to one blog it changed last year.

Plus on the HiKorea website (which ttompatz says is outdated)

Change of status of sojourn for Visa Waiver (B-1), Travel/Transit (B-2) status holder
In principle, Visa Waiver (B-1)/ Tourism/Transit (B-2) status holders are not eligible for change of status.
However, it is possible to get a status change if errors were found to have been committed during the Status Issuance Process at the Korean embassy and consulates overseas, or if unavoidable reasons such as national interests or humanitarian issues are found, change of status will be granted upon thorough Screening.
To check the requirements by the status of stay, please click the status of stay table on the top of this page or visit local immigration office. |
Still this interesting to know that the OP was able to get it done IN Korea.
Also wondering if a person can apply for a D-10 in another country? |
