I've searched the forum high and low and can't find anything exactly relating to my issue.

I got my CBC back and I have an arrest from when I was a minor 7 years ago for a 1st degree Misdemeanor. It was battery-touch or strike.

The charge was dropped with no persecution, yet it is showing up on my Background check.

My recruiter is saying it will be no problem with immigration as well as the Hagwon director.

I called Korean Immigration and they said it is reviewed on a case-by-case basis.

I wrote a letter describing the charge in Korean and English, describing exactly what it means to "not be persecuted" and how minor of a charge it was in the first place.

Do you think I'll be ok? Or get denied?

You are being persecuted even if you weren't prosecuted.

Your chances of getting a NEW E2, unless you qualify for an F-visa, are slim to none with a battery charge.

Really nothing remotely related to you....
Still good on you OP for trying to explain what your charge was to immi. Through you might have to try harder to explain. Even then chances are you might be denied.

Don't you mean 'prosecuted'? Unless I'm wrong and law enforcement do use that terminology in your country, in which case, apologies, but otherwise I don't think you should become an English teacher if you don't know the difference between the words 'prosecuted' and 'persecuted'. Laughing

Oh and that wrap-sheet above of all the waygooks that have criminal charges doesn't surprise me in the least... not sure why this life attracts such trouble makers...

No job for you, you didn't take the time to make sure you put the right word in your post or do spell checking. The English Nazis are at it again.

If the charges were dropped, see if a judge will order it off of your record. Even if the state removes it from the CRC you probably would have to contact the FBI to have it removed from the federal CRC.

If your recruiter says you have a chance, wait and see what happens. From what I've always heard, immi is "zero tolerance," but things can change in Korea, quickly and unexpectedly. Let us know how things go, OP.

If you're going to correct the other poster's spelling, you should probably check your own! Laughing The correct term is rap sheet.
